Charles County ss.t  Richard Roby late of Charles County Planter was attached to answer unto Rob.t
Scot and John Rowand of a plea of Trespass upon the Case and so forth

And Whereupon the same Robert Scot and John Rowand by Jeremiah Chase their attorney Complain
that whereas the said Richard Roby the Twenty Third day of December in the year of our Lord one Thousand
seven Hundred and forty Seven at Charles County afs.d was Indebted to the said Robert and John in the
Sum of one Thousand Nine Hundred and Eight Pounds of Tobacco for such articles as lye Properly in an acc.t as
by the Particular Account thereof herewith into Court brought may appear and the said Richard Roby
being so thereof Indebted in Consideration thereof afterwards to wit the day and year afs.d at the County
afs.d upon himself assumed and to the said Robert Scott and John Rowand then and there faithfully
Promised that he the said Richard Roby the said Sum of one Thousand Nine Hundred and Eight P.ds of
Tobacco to the said Robert and John when thereunto afterwards he should be Requested well and truly
would Content and Pay  Nevertheless the said Richard Roby his Promise and Assumption afs.d
not in the Least Regarding but minding and fraudulently Intending the said Robert Scott and
John Rowand in this Part craftilly and Subtilly to deceive and defraud the said Sum of one Thous.d
Nine Hundred and Eight Pounds of Tobacco or any Part thereof to them the said Robert and John
or Either of them hath not Paid or Contented altho the said Richard Roby was afterwards to wit on the
first day of June in the year of our Lord one Thousand Seven Hundred and forty Eight and often
since at the County afs.d by the said Robert and John thereto Requested  But the same to him or Either of
them hither to to Pay or for the same in any sort to Content the said Richard Roby hath hitherto altogether
Refused and still doth Refuse to the Damages of the said Robert Scott and John Rowand Three Thousand Eight
Hundred and Eighteen Pounds of Tobacco and therefore they bring suit and so forth                     John Doe
