(284) March Court Anno Domini 1748 Lord one Thousand Seven Hundred and forty Seven at Charles County afs.d was Indebted to the said Samuel In the Sum of one Thousand and Sixty Pounds of Tobacco for Divers Articles lying properly in an account as by the Particular Account thereof herew.th into Court brought may Appear and being so thereof Indebted the afs.d Edward in Consid.n thereof afterwards to wit the say and year afs.d at the County afs.d Upon himself Assumed and to the said Samuel then and there faithfully Promised that he the afs.d Edward the afs.d sum of One Thousand and Sixty Pounds of Tobacco to the said Samuel when thereunto Afterwards he shou'd be Requested well and truly wou'd Content and Pay Nevertheless the afs.d Edward his Promise and Assumption afs.d not Regarding but minding & fraudulently Intending the same Samuel In this Part Craftily and Subtilly to deceive and defraud the afs.d Edw.d the said sum of one Thousand and Sixty Pounds of Tobacco or any part thereof to the same Sam.l hath not Paid nor him for the Same in any sort Contented altho the afs.d Edward afterw.ds to wit the Tenth day of July In the year of our Lord one Thousand Seven Hundred forty Eight and often afterwards at Charles County afs.d by the same Samuel hath been Requested but the same to him hither to to Pay or him for the Same in any sort to Content hath hither to Altogether Refused and Still doth Refuse to the Damage of the same Samuel Two Thous.d one Hundred and Twenty Pounds of Tobacco and therefore suit is brought and so forth John Doe Pled.s &C.a & Rich.d Roe 1747 Edward Davis son of Henry D.r
thereof or any Security or satisfaction for the Same or any Part thereof more then there is due Credit Given for to the best of his Knowledge and at the same time Samuel Hanson Jun Came before me and made Oath in Manner afs.d that Neither he nor any Person for his use by his means Ever Received any Part or Parcel thereof or any Security or Satisfaction for the same more then he has given due Credit for to the best of his Knowledge S Hanson Certified the 15.th March 1748/9 by Dan.l of S.t Tho.s Jenifer Whereupon at the Prayer of the said Samuel it is Ruled that the said Edward give Special Bail in the Plea afs.d and for want thereof the said Edward Present here in Court is Committed in the Custody of the Coroners Namely Samuel Chunn Gentleman there to Remain until &Ca And the afs.d Edward in his Proper person in Custody as afs.d Comes and defends the force & (Injury) |
