(71 Which being Read and heard the said Richard Gambra by his attorney afs.d Comes and defends the force and Injury when &C.a and the said attorney saith that he is not Informed by the said Richard of any answer to be Given for Richard to the said John Muschett in the Premises nor hath he any other thing to say thereof in barr or preclusion of the action aforesaid of him the said John Muschett whereby the same John Muschett Remains against the said Richard Gambra thereof undefended Therefore it is Considered that the s.d John Muschett Recover against the said Richard Gambra his Debt & Costs afs.d and his Damages by Occasion of Detaining that Debt to Four Hundred & Eighty one pounds of Tobacco to the same John Muschett or his assembly the Def.t in mer Court here adjudged and the said Richard Gambra in Mercy &Ca Mem.o plaintiff Releases [illegible] & Costs
Charles County ss.t Thomas Mudd late of Charles County Planter otherwise Called Thomas Mudd of Charles County Planter was summoned to answer unto John Muschett of a plea that he Render him the Just and full sum of Twelve Thousand Two Hundred pounds of good sound Merchantable Leaf Tobacco in Cask which to him he owes and unjustly detains and so forth And Whereupon the same John by Jeremiah Chase his attorney saith that whereas the afs.d Tho.s Mudd by the Name of Tho.s Mudd of Charles County Planter on the Eleventh day of august in the year of our Lord one Thousand Seven Hundred & forty six at Charles County afs.d by his Certain Writing Obligatory under the hand & seal of the said Tho.s bearing date the day and year last Named Granted himself to be held and firmly bound to the aforesaid Corn.s Sandford his Heirs Ex.rs Adm.rs or Assigns the Just & full sum of Twelve Thousand Two Hundred Pounds of Good Sound Merchantable Leaf Tob.o in Cask to be paid unto the said Corn.s Sandford his Certain attorney Ex.rs Adm.rs or Assigns at or upon the first day of January Next Ensuing the date hereof and the said John further saith that the afs.d Corn.s Sandford after the Twenty first day of September In the year of our Lord one Thousand Seven Hundred & forty four to wit the Twenty Seventh day of February In the year of our Lord One Thousand Seven Hundred & forty six at Charles County afs.d by his Certain Writing under the hand and seal of him the said Corn.s Sandford bearing date the day and year last mentioned according to the form & Effect of the Act of Assembly in such Cases made & Provided Assigned the said Writing obligatory to the said John for Value [illegible] as therein mentioned of which said Assignment the said John afterwards to wit on the said Twenty Seventh day of February in the year Last mentioned at Charles County afs.d to the said Thomas Mudd gave notice and the said John in fact saith that the said Thomas altho' often Required the aforesaid sum of Twelve Thousand two Hundred Pounds of Tobacco to the said John hath not Paid nor any part thereof nor for the same in any sort Contented but the same to him to pay hath hitherto altogether Refused Refused by Virtue of which Assignment & of the Act of Assembly by Action hath accrued to the said John to have and Require of the said Thomas the afs.d sum of Twelve Thousand Two Hundred pounds of Good Sound Merchantable Leaf Tobacco in Cask afs.d Yet the afs.d Tho.s altho' often Required (that) |
