(51 Should make the same Attachment that he she or they be and appear before the Justices of the said Lord Proprietary at the Place and time afs.d to shew Cause if any he she or they have why the sum in their or any of their hands attached should not be Condemned according to Law and the said Joseph have thereof Execution if &C.a and how he should Execute that Writt that he should make Known to the Justices afs.d at the time and place afs.d and that he should have then and there that Writt and the Names of those before whom he should make the Known &Ca And now here at this day to wit the second Tuesday in March aforesaid Comes the said Joseph by Jeremiah Chase his Attorney and offers himself against the said Notley in the plea afs.d and the Sheriff afs.d Returns to the Court here the Writ afs.d thus Indorsed Viz.t Charles County ss.t I Hereby Certifie to the Worshipfull the Justices within ment.d that by virtue of the within Writ to me Directed on the Third day of March 1746 I attached in the hands of the Plaintiff the whole Damages and Costs and on the 6.th day I attached in the hands of James Allen the whole Damages & Costs and on the 10.th day of the same Month I Attached in the hands of John Davis the whole Damages & Costs and I have made known to the Garnashees afs.d that they be and appear before the Justices afs.d at the Time and place within Prescribed to shew Cause why the same Effects so Attached in their hands should not be Condemned according to Law to and for the Use of the said within mentioned Joseph Doyne before W.m Hanson Tho.s Thompson Jun.r Fran.s Ware & John Hanson ye Good and Lawfull men of Bailywick as I am hereby Commanded So answers S Hanson She And the aforesaid James Allen into Court here in his proper person Comes & Confesses that at the Time of laying the attachment aforesaid he had and stil has of the Effects of the said Notley Gordon to the Value of One Hundred ^& Sixty^ Pounds of Tobacco and no more the said John Davis in like manner Confesses Two Hundred Pounds of Tobacco and Two Barrels of Corn and no more the said Joseph Doyne in like manner Confesses Six Hundred Pounds of Tobacco and no more Whereupon the said Joseph Doyne by Jeremiah Chase his Attorney afs.d prays Condemnation of the Sums of Tobacco & Corm so as afs.d in the hands of the Garnashees afs.d and by them Confessed with Execution thereof to him to be adjudged Therefore it is Considered by the Court here that the said Joseph Doyne have Condemnation of the Sums of Tobacco & Corn afs.d in the hands of the Garnashees afs.d by the Court here Adjudged according to the form force and Effect of the Act of Assembly in such Cases late made & Provided & that the s.d Jo.s have thereof Ex.n if &C.a Mem.o the Corn Valued at 100ll of Tobo p Barrell p Edmund Porteus Levy on bond |
