(49 And the said John in his proper person Comes & defends the force & Injury when &C.a and Saith that he Cannot deny the Action afs.d of him the said Thomas nor but that he did assume upon himself in manner and form as the said against him hath Complained nor also but that the s.d Thomas hath sustained Damages by means of not Performing the promises & assumptions aforesaid to Three pounds four shillings & Six pence sterling or Seven pounds Three shillings Currency as the said Thomas above in declaring supposes Whereupon the said Thomas by his attry aforesaid Comes and prays Judgment of those Damages so acknowledged together with his Costs & Charges by him about his Suit in this part laid out and Expended to him to be adjudged Therefore it is Considered by the Court here that the said Thomas Recover against the said John his Damages afs.d to Three pounds four Shillings & Six pence Sterling or Seven pounds Three shillings Currency as above acknowledged as also the sum of Two Hundred & forty four Pounds of Tobacco for his Costs & Charges by him about his suit in this part laid out and Expended on Defendant in Mer his assent by the Court here adjudged and the said John in Mercy &C.a It was Commanded the sheriff that he should take Edward Sanders late of Cha.s County Planter if &C.a and him safe keep so that he should have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the Second Tuesday in March Next to satisfy unto Joseph Noble Jun.r as well the sum of Three pounds Seventeen Shillings and Ten pence Curr which to the same Joseph in the Court of the Lord Proprietary aforesaid before the Justices aforesaid were adjudged for his Damages which he had by occasion of a Certain Promise and Assumption aforesaid to the same Joseph at Charles County aforesaid made & unperformed as also Three Hundred and Eighty Eight pounds of Tobacco which to the same Joseph of his assent were adjudged for his Costs and Charges by him about his suit in this part laid out and Expended whereof the said Edward is Convict &C.a and that he should have then and there that Writt &Ca And now here at this day to wit the Second Tuesday in March aforesaid the sheriff aforesaid Returns to the Court here the Writt aforesaid thus Indorsed Vizt Supersedded S Hanson She |
