And the afs.d John in his proper person
Comes and defends the force and Injury when
&C.a and says that he Cannot deny the action
afs.d of him the said Samuel nor that he
did assume upon himself in manner &
form as the said Samuel against him
hath Complained nor also but that the s.d
Samuel hath Sustained Damages by
means of not Performing the promises and
assumptions afs.d to Three Thousand six
Hundred and forty one pounds of Tobacco
as the said Samuel above in Declaring
supposes             Whereupon the said
Samuel by Jeremiah Chase his attorney afs.d
prays Judgment and those Damages
acknowledge together with his Costs & Charges
by him about his suit in this part laid out &
Expended to him to be adjudged

Therefore it is Considered by the Court here that he said Samuel do Recover against the said John
his Damages afs.d to Three Thousand Six Hundred and forty one pounds of Tobacco above acknowledged
as also the sum of Three hundred Eighty and one Quarter of a pound of Inspected Tobacco for
his Costs and Charges by him about his suit in this part laid out and Expended on his
Def.t in mea   assent by the Court here adjduged and the said John in Mercy &Ca

It was Commanded the sheriff that he should take William Barker late of Charles County
Planter if &C.a and him safe keep so that he should have his body before the Justices of
the Lord Proprietary of his Next County Court to be holden at Charles Town on the Second
