(412) March Court Anno Domini 1747
It was Commanded the sheriff that he should take Christopher Wilkinson late of Charles County Planter if &C.a and him safe keep so that he should have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the Second Tuesday in March Next to answer unto William Neale of a plea of Trespass upon the Case and so forth and that he should have then and there that Writt &Ca At which day to wit the Second Tuesday in March afs.d Comes the said William by Henry Darnall his Attorney and offers himself against the said Christopher and the sheriff afs.d Namely Thomas Hungerford Gentleman Returns to the Court here that he has taken the body of the said Christopher Whereupon into Court here in his proper Person Comes Aaron Nalley of Charles County and becomes pledge and security for the afs.d Christopher that if it should happen that the afs.d Christopher in the plea afs.d as all Costs which to the same William in this part should be adjudged of his Lands and Chattles should be made and Levied to and for the use of William If it should happen the said Christopher the Damages and Costs afs.d to the said William should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the afs.d Christopher in his Proper Person Comes and defends the force and Injury when &C.a and saith that he Cannot deny the Action afs.d of him the said William nor but that he owes to the said William the sum of one Thousand Two Hundred and Seventy Eight Pounds of Tobacco as the said William above supposes Whereupon the said William by his attorney afs.d prays Judgment and those Damages so acknowledged together with his Costs and Charges by him about his suit in this Part laid out and Expended to him to be adjudged Therefore it is Considered by the Court here that the said William do Recover against Christopher his Damages afs.d to One Thousand Two Hundred and Seventy Eight Pounds of Tobacco above acknowledged as also one Hundred and fifty Two & ^Three Quarter of a^ Pound of ^Inspected^ Tobacco for his Costs and Charges by him about his suit in this part laid out and Expended on his assent by Def.t in mea the Court here adjudged and the said Christopher in Mercy &Ca
