(399) Complains that whereas the said Thomas the Nineteenth day of February in the year of our Lord one Thousand Seven Hundred and forty six at Charles County afs.d was Indebted to the said William Reynolds in the sum of six pounds Currency for divers articles lying Properly in an account as by the Particular account thereof herewith into Court brought may appear and being so thereof Indebted the afs.d Thomas in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon him self assumed and to the said William then and there faithfully Promised that he the afs.d Thomas the afs.d sum of six pounds Currency to the said William when thereunto afterwards he should be Requested well and Truly would Content and pay Nevertheless the aforesaid Thomas his Promise and assumption afs.d not Regarding but minding and fraudulently Intending the same W.m In this part Craftilly and Subtilly to deceive and Defraud the afs.d Thomas the said sum of Six pounds Currency on any part thereof to the same William hath not paid nor him for the same in any sort Contend altho the afs.d Thomas afterwards to wit the first day of December in the year of our Lord One Thousand Seven Hundred and forty Seven and often afterwards at Charles County afs.d hath been Requested but the same to him hither and Still doth Refuse to the Damage of the same William Twelve pounds Currency and therefore suit is brought and so forth John Doe Pledg.s &C.a & Richard Roe 1746 M.r Thomas Howard of Charles County Pukawaxon Dr
A County ss.t the 23.d day of December 1747 William Reynolds Personally appeared before me the Subscriber one of his Lordships Justices of Annearundell County and made oath ^up^on the Holy Evangelist of almighty God that the above account is Just & True and that he hath not Received any part or parcell thereof nor any security or satisfaction for the same Sworn Day and year aforesaid before me Richard Dorsey Whereupon into Court here in his Proper Person Comes William Middleton of Charles County Merchant and becomes Pledge and Security for the said Thomas that if it should happen the said Thomas in the plea afs.d should be Convict that then the s.d Thomas Yeilded and Granted that as well the Damages afs.d as all Costs which to the said William Reynolds in this part should of his Lands and Chattles should be made and Levied to and for the use of the said Wm Reynolds that if it should happen that the said Thomas the Damages and Costs afs.d to the said William Reynolds should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the afs.d Thomas in his proper Person Comes and defends the force and Injury when &C.a and says that he Cannot deny the Action afs.d of him the said William Reynolds nor but that he did assume upon himself in manner and form as the said W.m against him hath Complained nor also but that the said W.m hath sustained Damages by means of not Performing the Promises and Assumptions afs.d to six pounds Currency as the said William above in declaring supposes (Whereupon) |
