(397) Subtilly to deceive and defraud the said sum of Nine Hundred Pounds of Nett Tobacco as afs.d or any Part thereof to the said James and Richard hath not Paid or in any sort Contented Altho so to do the said Charles by the said Ja.s and Richard hath been Requested to wit on the fifth day of November in the year of our Lord one Thousand Seven Hundred and forty seven and often since at Charles County afs.d to pay the same but that hither to to pay or Content the s.d Charles Philpott Hath altogether Refused and stil doth Refuse to the Damage of the said James and Richard Gildarts Eighteen Hundred Pounds of Nett Tobacco as aforesaid and therefore suit is brought and so forth John Doe pled.s &C.a & Rich.d Roe And the afs.d Charles in his proper Person Comes and defends the force & Injury when &C.a and says that he Cannot deny the action afs.d of him the said James & Richard nor but that he did assume upon himself in manner and form as the s.d James and Richard against him hath Complained nor also but that the said Ja.s and Richard hath sustained Damages by means of not Performing the Promises and Assumptions aforesaid to Nine Hundred Pounds of Nett Tobacco as the said James and Richard above in declaring supposes Whereupon the said James and Richard by Jeremiah Chase their attorney afs.d prays Judgment and those Damages so acknowledged together with their Costs and Charges by him about their suit in this part laid out and Expended to them to be adjudged Therefore it is Considered by the Court here that the said James and Richard do Recover against the said Charles ^their^ his Damages afs.d to Nine Hundred Pounds of Nett Tobacco above acknowledged as also the sum of one Hundred and Ninety five Pounds of Inspected Tobacco for their Costs & Charges by him about his suit in that Part laid Def.t in mea out and Expended on his ^their^ assent by the Court here adjudged and the s.d Cha.s in Mea &Ca
Charles County ss.t George Tarvin late of Charles County Innholder was attached to answer unto Wm Theobalds of a Plea of Trespass upon the Case And Whereupon the same William by Thomas Clark his attorney Complains that whereas the said George the Day of In the year of our Lord one Thousand seven Hundred and forty six at Charles County afs.d was Indebted to the said William in the sum of Eight Thousand Eight Hundred and Thirty seven pounds of Tobacco for divers Particulars lying Properly in an account as by the Particular account thereof herewith into Court brought may appear and the said George being so thereof Indebted in Consideration thereof afterwards (to wit) the day and year afs.d at the County upon himself assumed and to the said William then and there faithfully Promised that he the afs.d George the afs.d sum of Eight Thousand Eight Hundred and Thirty seven Pounds of Tobacco to the said William when thereunto afterwards he should be requested well & truly would (Content) |
