(395) 1744 John Maccoy D.r 1744 Contra Cr
Whereupon into Court here in his Proper Person Comes Hugh Perrie of Charles County Merchant and becomes Pledge and Security for the said John that if it should happen the said John in the plea afs.d should be Convict that then the said Hugh Yeilded and Granted that as well the Damages aforesaid as all Costs which to the said Samuel in this part should be adjudged of his Lands and Chattles should be made and Levied to and for the use of the said Samuel that if it should happen that the said John the Damages and Costs afs.d to the said Samuel should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the afs.d John in his proper Person Comes and defends the force and Injury when &C.a and says that he Cannot deny the action afs.d of him the said Samuel nor but that he did assume upon himself in manner and form as the said Samuel against him hath Complained nor also but that the said Samuel hath sustained Damages by means of not Performing the Promises and Assumptions aforesaid to One Thousand Nine Hundred and seventy five ^forty one^ pounds of Tobacco & six shillings and five pence Currency as the said Samuel above in declaring supposes Whereupon the said Samuel by Jeremiah Chase their attorney afs.d prays Judgm.t and those Damages so acknowledged together with his Costs and Charges by him about his suit in this Part laid out and Expended to him to be adjudged Therefore it is Considered by the Court here that the said Samuel do Recover against the said John his Damages afs.d to Nineteen Hundred and forty one Pounds of Tobacco & Six shillings and five pence Currency above acknowled as also the sum of Two Hundred and sixty seven Pounds of Tobacco before the Inspection Law & sixty ^Ninety^ seven Pounds of Inspected Tobacco for his Costs and Charges by him about his suit in that Part laid Def.t in mea out and Expended on his assent by the Court here Adjudged and the said John in Mea &Ca
It was Commanded the Sheriff that he should take George Tarvin late of Charles County Innholder if &C.a and him safe keep so that you have his body before the Justices of the Lord (Propry) |
