38) March Court 1746 And now here at this day to wit the Second Tuesday in March afs.d Comes the aforesaid Samuel by Jeremiah Chase his Attorney afs.d and often himself against the said John in the Plea afs.d and one ^of the^ Coroners Namely Matt.w Barnes Gent Return to the Court here that the said John in his Bailywick is those Cases late made and provided a Copy of the following Declaration Viz.t Charles County ss.t John Nally late of Charles County Planter was attached to Answer unto Samuel Hanson Jun.r High sheriff of Charles County of a Plea of trespass upon the Case And Whereupon the same Samuel Hanson Jun.r by Jeremiah Chase his Attorney Complains that whereas the said John Nally the Nineteenth day of December In the year of our Lord One Thousand Seven Hundred and forty four at Charles County aforesaid was Indebted to the said Samuel Hanson Junr In the Sum of Twelve Hundred and Twenty five pounds of Tobacco for divers Articles lying Properly in an Account as by the Particular account thereof herewith into Court brought may appear and being so thereof Indebted the aforesaid John ^Nally^ in Consideration thereof afterwards to witt the day and year aforesaid at the County aforesaid upon himself assumed and to the said Samuel Hanson Jun.r then and there faithfully Promised that he the aforesaid John the aforesaid Sum of Twelve Hundred and Twenty five pounds of Tobacco to the said Samuel Hanson Junr when thereunto afterwards he should be requested well and truly would COntent and Pay Nevertheless the aforesaid John Nally his Promise and Assumption afs.d not Regarding but minding and fraudulently Intending the same Samuel In this Part Craftily and Subtilly to deceive and defraud the aforesaid John Nally the afs.d Sum of Twelve Hundred and Twenty five pounds of Tobacco or any part thereof to the same Samuel hath not paid nor him for the same in any sort Contented altho the aforesaid John Nally afterwards to wit the Tenth day of February in the year of our Lord One Thousand Seven Hundred and forty five and often afterwards at Charles County afs.d by the same Samuel hath been Requested but the same to him hither to to pay or him for the same in any sort to Content hath hitherto Altogether Refused and Still doth Refuse to the Damage of the same Samuel Hanson Junior Two Thousand four Hundred and fifty pounds of Tobacco and therefore suit is brought and so forth Pled.s &Ca
