Judgment p Nonsum

Charles County ss.t  Richard Smith Sen late of Charles County Planter was
attached to answer unto Samuel Hanson Junior High Sheriff of Charles
County afs.d of a Plea of Trespass upon the Case and so forth

And Whereupon the same Samuel by Jeremiah Chase his attorney
Complains that whereas the said Richard Smith Sen on the Twenty fifth
day of February in the year of our Lord One Thousand Seven Hundred and
forty Six at Charles County afs.d was Indebted to the said Samuel in the
sum of four Thousand six Hundred and fifty four Pounds of Tobacco for
divers particulars lying properly in an account as by the Particular account
thereof herewith into Court brought may appear and being so thereof Indebted
the aforesaid Richard in Consideration thereof upon himself assumed afterw.ds
to wit the day and year afs.d at the County aforesaid and to the said Samuel then &
thereof faithfaithfully Promised that he the afs.d Richard the said sum of four
thousand six Hundred and fifty four pounds of Tobacco to the said Samuel
when thereunto afterwards he should be Requested well and truly would Content
& Pay  Nevertheless the aforesaid Richard his Promise and Assumption afs.d
not Regarding but minding and fraudulently Intending the same Samuel in
this Part craftily and subtilly to deceive and defraud the aforesaid Richard the said
sum of Four Thousand Six Hundred and fifty four pounds of Tobacco or any part
thereof to the same Samuel hath not Paid nor him for the same in any wise
Contented altho the afs.d Richard afterwards to wit the first day of May in the
year of our Lord One Thousand Seven Hundred and forty Seven and often afterwards
at the County afs.d by the same Samuel hath been Requested but the same to him hither
to to Pay or for the same in any sort to Content hath hitherto altogether Refused
and still doth Refuse to the Damage of the same Samuel Nine Thousand
Three Hundred and Eight Pounds of Tobacco and therefore suit is brought
