(374) March Court Anno Domini 1747 Pay Nevertheless the afs.d Richard his Promise and Assumption afs.d not Regarding but minding and fraudulently Intending the same Thomas in this Part craftily and subtilly to deceive and defraud the afs.d Richard the afs.d sum of Thirteen Hundred and Seventy Eight Pounds of Tobacco or any Part thereof to the same Thomas hath not Paid nor him for the same in any sort Contented altho' the afs.d Richard afterwards to wit the Tenth day of April In the year of our Lord one Thousand seven Hundred and forty Seven and often afterwards at Charles County afs.d by the same Thomas hath been Requested but the same to him hitherto to pay or him for the same in any sort to Content hath hither to altogether Refused and still doth Refuse to the Damage of the same Thomas Two Thousand seven Hund.d and fifty six Pounds of Tobacco and therefore suit is brought & so forth John Doe Pledg.s &Ca & Richd Roe 1745 M.r Richard Norwood D.r
Charles County ss.t On the 25 day of February 1747 the Book of Account from which the above account is truly Copy'd was produced to me in which Book in folio 96 stands the above account and in folio 112 stands the following probate Vizt Maryland Charles County ss.t May 3d 1746 Then Came before me one of his Lordships Justices of Charles County Thomas Midgley and made oath on the Holy Evangelist of Almighty God that the accounts in this book from Folio 1 to Folio 112 as they stand stated are just and true and that he nor any Person ever Received any Part or Parcel thereof or any satisfaction or security sworn before me Jn.o Winters And same day Jacob Holme made oath he hath not Received any Part or Parcel of the above account or any satisfaction or security for the same sworn before & Certify'd by Rob.t Yates Whereupon into Court here in his Proper Person Comes James Freeman of Charles County Innholder and becomes Pledge and security for the afs.d Rich.d that if it should happen the said Richard in the Plea afs.d should be Convict that then the said James yeilded and Granted that as well the Damages afs.d as all Costs which to the same Thomas in this part should be adjudged or his Lands and Chattles should be made & Levied of to and for the use of the said Thomas if it should happen the said Richard the Damages and Costs afs.d should not Pay or his body into the Custody of the sheriff by Reason thereof Render (And) |
