Anno Domini 1747 Comes ^here^ as well the said Joseph as the said John by their attorneys afs.d and the said John by his said attorney prays further leave thereof to Imparle hereto until the Next Court to be holden at Charles Town on the second Tuesday in March and he hath it and the same day is given the said Joseph here &Ca And now here at this day to wit the Second Tuesday in March afs.d Comes as well the said Joseph by his attorney afs.d as the s.d John by his attorney afs.d and the said John by his said attorney Comes and defends the force and Injury when &C.a Whereupon all and Singular the Premises being by the Court here (according to the Directions of the Act of Assembly in such Cases late made and Provided fully seen heard and understood) and due Deliberation thereupon had It is adjudged and Decreed that the said Joseph Allen Recover against the said John Sly as well the sum of one Thousand four Hundred Pounds of Tobacco for his Debt aforesaid as also the sum of Pounds of Tobacco for his Costs and Charges by him about his suit In this Part laid out and Expended and the said John Sly in Def.t in Mea Mercy &C.a
This being an Action upon the Case for the Recovery of Twelve Hundred Pounds of Tob.o due on a Note to the said John Barber from the said John Sanders the said John Sanders was by Virtue of a Capias Ad Respondendum Returnable before his Lordships County Court on the second Tuesday in November Seventeen Hundred and forty five arrested and then and there appearing It was by Jeremiah Chase attorney for the said John Barber Prayed that the said John Sanders might give special bail Whereupon into Court here in her proper person Comes Eleanor Sanders of Charles County Widow and becomes Pledge and Security for the afs.d John Sanders that if it should happen that the afs.d John Sanders in the plea afs.d should be Convict that then the said Eleanor yeilded and Granted that as well the Damages afs.d as all Damages ^Costs^ which to the same John Barber in this Part should be adjudged of his Lands & Chattles should be made and Levied to and for the use of the said John Barber If it should happen the said John Sanders the Damages and Costs afs.d to the said John Barber should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the said John Sanders by Henry Darnall his attorney Comes and defends the force and Injury when &Ca and prays leave thereof to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in March Next an he hath it and the same day in Given to the same John Barber here &Ca At which day to wit the Second Tuesday in March aforesaid Comes here as well the said John Barber as the s.d John Sanders by their attorneys afs.d and the said John Sanders by his said attorney prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in June Next and he hath it and the same day is given to the same John Barber here &Ca At which day to wit the second Tuesday in June afs.d Comes here as well the said John Barber as the said John Sanders by their attorneys afs.d and the said John Sanders by his said attorney Prays further leave to Imparle here to until the Next Court to be holden at Charles Town on the second Tuesday in August Next (and) |
