265 Which being Read and heard the said John by his attorney afs.d Comes & defends the force and Injury when &Ca and the same attorney saith that he is not Informed by the same John of any answer to make for the said John to the said Samuel in the action of the afs.d Samuel by which the same Samuel Remains against the said John thereof without Defence Therefore it is Considered that the said Samuel Recover against the said John his Debt afs.d and his Damages by occasion of detaining ^that debt^ to Three Hundred and Fifty five pounds of Tobacco Def.t in Mea to the same Samuel of his assent by the Court here adjudged & the s.d John in Mercy &Ca
Charles County ss.t Philip Wood late of Charles County in the province of Maryland Taylor otherwise Called Philip Wood of Charles County Taylor was summoned to answer unto Samuel Hanson Junr of the same County & Province of a plea that he REnder unto him the Just & full sum of one Thousand Nine Hundred and Sixty Eight Pounds of Good Tobacco which to him he owes and Unjustly detains and so forth And Whereupon the said Samuel by Jeremiah Chase his attorney saith that whereas the said Philip on the sixteenth day of April in the year of our Lord one Thousand seven Hundred and forty Seven at Charles County afs.d by his Certain Writing Obligatory with the seal of him the said Philip Sealed and herein Court Produced whose date is the day and year afs.d acknowledged himself to be held & firmly bound unto the said Samuel In the sum of one Thousand Nine Hundred & sixty Eight Pounds of Good Tobacco to the said Samuel when thereunto afterwards he should be Requested Nevertheless the said Philip altho' often Requested the said sum of One Thousand Nine Hundred and Sixty Eight pounds of ^Good^ Tobacco or any part thereof to him the said Samuel Hanson Jun Three Thousand Nine Hundred & Thirty Six pounds of Good Tobacco and therefore suit is brought and so forth John Doe Pled.s &C.a & Rich.d Roe And the afs.d Philip in his proper person Comes and defends the force & Injury when &C.a and prays a hearing of the Writing obligatory and it is Read unto him he also prays a hearing of the Condition of the same Writing and it is Read unto him in these Words following Vizt The Condition of the above obligation is such that if the above bound Philip Wood do and shall well & truly pay or Cause to be paid unto the said Saml Hanson Jun his Certain Attorney Ex.rs Adm.rs or Assigns the Just and full sum of Nine Hundred and Eighty four pounds of Good Tobacco in Cask in said County at or upon the first day of May Next Ensuing the date hereof with Legal Interest for (the) |
