(252) November Court Anno Domini 1747 Whereupon It was Commanded the sheriff that of the Goods Chattles & Credits of the aforesaid Peter Oard in his Bailywick being he should attach as well the sum of Nineteen Hundred and forty Two pounds of Tobacco Damages at one Thousand Pounds of Tobacco for Costs that had accrued and that further he should suffice in prosecution of the Premises and when the same he had attached or any part thereof that he should he out before the Justices of the Lord Proprietary of his Next County Court to be held at Charles Town on the second Tuesday in November Next then & there to be Condemned according to Law to and for these of the said Samuel unless the said Peter should come then and there by himself or Lawful Attorney and [illegible] to the said Samuel of a plea of Trespass upon the Case and that by Good and Lawfull money his Bailywick he should make known to the person or persons in whose hands he should make the same attachment that he she or they be and appear before the Justices of the said Lord Proprietary at the place and Time afs.d to shew Cause if any he she or they have why the sum in their or any of their hands attached should not be Condemned according to Law and the said Samuel have thereof Execution if &C.a and how he should Execute that Writ that he should make known to the Justices afs.d at the Time and place aforesaid and that he should have then and there that Writ and the Names of those before whom he should make the same known &ca And now here at this day to wit the second Tuesday in November afs.d Comes the said Samuel in his proper person and offers himself against the said Peter in the plea afs.d and the sheriff afs.d Returns to the Court here that Writ afs.d thus Indorsed Charles County ss.t I hereby Certifie that by Virtue of the within Writ to me Directed on the 26.th day of october 1747 I attached in the hands of the within Named Sam Hanson Jun sundry the Effects of the within Named Peter Oard amounting to Eight Hundred & Seventy Six pounds of Tobacco as p a schedule of Appraisment thereof here to come & It appears I further Certifie that at the same Time I attached in the hands of William Oard lines the Effects of the within Named Peter Oard to and for the use of the said Hanson the sum of Two Thousand Pounds of Tobacco and I have made Known to the Garnashees abovementioned that they be and appear before the Justices afs.d at the time and place within prescribed to shew Cause if they or either of them have why the said effects so attached in their hands should not be Condemned for the Use of the said Hanson before Francis Green Sen & Wm Clements sen good & lawful men of my Bailywick as I am hereby Commanded so answers Tho.s Hungerford She With which Return was Returned the following Schedule Vizt Charles County ss.t We the subscribers being summoned and sworn by the sheriff of the County aforesaid to Appraise and Value sundry the Effects of Peter Oard on an attachment to and for the use of Samuel Hanson Junior do Value the same as followeth Vizt Brought Up 460
