Anno Domini 1747
(249) Charles County ss.t Whereas Joseph Doyne hath made it appear to me that Levet Gates hath obsconded and Runaway and that he is Indebted unto him the sum of one Thousand Two Hundred and Twenty four four pounds of Tob.o These are in his Lordships Name to Require you out attachment against the effects of the said Levet Gates for the afs.d Sum of one Thousand Two Hundred and Twenty as it will appear by the said Joseph Doyne account for said given under my hand this 19.th day of October 1747 Tho.s Stone To Mr Edmund Porteus Clk of Charles County Whereupon It was Commanded the sheriff that of the Goods Chattles & Credits of the afs.d Levet Gates in his Bailywick being he should attach as well the sum of Twelve Hundred & Twenty four pounds of Tobacco Damages as six Hundred Pounds of Tobacco for Costs that had accrued and that further should accrue in prosecution of the premises and when the same he had attached or any part thereof that he should have before the Justices of the Lord Proprietary of his Next County Court to be held at Charles Town on the Second Tuesday in November Next then & there to be Condemned according to Law to and for the use of the said Joseph unless the said Levet should Come then and there by himself or Lawfull attorney and answer unto the said Joseph of a plea of Trespass upon the Case and that by Good & Lawfull men of his Bailywick he should make Known to the person or persons in whose hands he should make the same attachment that he she or they be and appear before the Justices of the said Lord Proprietary at the place and Time afs.d to shew Cause if any he she or they have why the sam in their or any of their hands attached should not be Condemned according to Law and the said Joseph have thereof Execution if &C.a and how he should Execute that Writ that he should make known to the Justices afs.d at the Time and Place aforesaid and that he should have then and there that Writ and the Names of those before whom he should make the same known &Ca And now here at this day to wit the Second Tuesday in November afs.d Comes the said Joseph by Jeremiah Chase his attorney and offers himself against the said Levet in the plea afs.d & the sheriff afs.d Returns to the Court here the Writ afs.d thus Indorsed Charles County ss.t I hereby Certifie to the Worshipful the Justices within ment.d by Virtue of the within Writ to me Directed that on the 19.th day of October 1747 I attached in the hands of Virlinda Sanders the Whole Damages & Costs and on the 20.th day of October 1747 I attached in the hands of Wm Duncan the Whole Damages & Costs and I have made known to the Garnashees of the afs.d Levet Gates within mentioned that they be and appear before the Justices of said County Court at the time and place within Prescribed to shew Cause why the same Effects so attached in their hands Each of their hands should not be Condemned and for the Use of the within mentioned Joseph Doyne Before Wm Sanders Edward Sanders Thomas Keybert & James Keech Jun.r Good & Lawful men of my Bailywick as I am hereby Commanded So answers Thomas Hungerford She |
