(235) The Sum of Six Hundred Pounds of Tobacco and one Levy Damages as six Hundred Pounds of Tobacco for Costs that had accrued and that further should accrue in Prosecution of the Premises and when the same he had attached or any part thereof that he should have it before the Justice of the Lord Proprietary of his Next County Court to be held at Charles Town on the second Tuesday in November Next then & there to be Condemned According to Law to and for the Use of the said Bowling unless the said Mark should Come then and there by himself or Lawfull attorney and Answer unto the said Bowling of a plea of Trespass upon the Case and that by Good and Lawfull money his Bailywick he should make known to the Person or Persons in whose hands he should make the same attachment that he she or they be and appear before the Justices of the said Lord Proprietary at the place and Time afs.d to shew Cause if any he she or they have why the sum in their or any of their hands attached should not be Condemned according to Law and the said Bowling have thereof Execution if &Ca and how he should Execute that Writt that he should make known to the Justices aforesaid at the time and Place afs.d and that he should have then and there that Writt and the Names of those before whom he should make the same Known &Ca And now here at this day to wit the second Tuesday in November afs.d Comes the said Bowling by Jeremiah Chase his attorney and offers himself against the said Mark in the plea afs.d & the sheriff aforesaid Returns to the Court here the Writt afs.d thus Endorsed Charles County ss.t I hereby Certifie to the Worshipfull the Justices within mentioned that by Virtue of the within Writt to me Directed on the 14.th 7ber 1747 I attached in the hands of John Smith and Thomas Speak and on the Eighteenth of the same month in the hands of John Baggot in each of their hands the whole Damages and Costs within mentioned as the effects of the w.thin Names Mark Knowles to answer the use of Bowling Speak and I have made known to the Garnishees above mentioned that they be and appear before the Justices afs.d at the Time and place within prescribed to shew Cause why the said Effects so attached in their hands should not be Condemned according to Law before Notly Maddox James Keach and William Middleton Jun.r Good & lawfull men of my Bailywick as I am hereby Commanded so answers Sam: Hanson She And the afs.d John Smith into Court here in his proper person Comes and Confesses that at the time of laying the attachment afs.d he had and still has of the effects of the said Mark Knowles to the Value of five Hundred & fifteen Pounds of Tobacco and no more the said Thomas speak in like manner Confesses Three Hundred and Sixteen Pounds of Tobacco and no more the said John Baggot in like manner Confesses Three Hundred and Sixty Pounds of (Tobo) |
