Charles County ss.t Joseph Nally late of Charles County planter was attached to
                               answer unto James Russell & Com of a plea of Trespass upon
                               the Case

    And Whereupon the said James & Com by Jeremiah Chase their attorney
Complain for that whereas the said Joseph on the Sixteenth day of March in the year
of our Lord one Thousand Seven Hundred and forty five at Charles County afs.d was
Indebted unto the said James & Com in the sum of fifteen Hundred and fifty Two pounds
of Tobacco for divers Particulars lying properly in account as by a Particular account
thereof herewith into Court brought may appear and the said Joseph being so thereof
Indebted in Consideration thereof afterwards (to wit) the day and year afs.d at the County
afs.d upon himself assumed and to the same James & Com then & there faithfully Promised
that he the said Joseph the said sum of fifteen Hundred and fifty Two pounds of Tobacco to
them the said James & Company would well and truly Content and pay when thereunto
afterwards he should be requested  Nevertheless the said Joseph his promise &
assumption afs.d in form afs.d made not in the least Regarding but minding and
fraudulently intending them the said the said James & Company in this part craftily
and subtilly to deceive and defraud the said Joseph the said Sum of fifteen Hundred
and fifty Two pounds of Tobacco or any part thereof to them the said James & Company
hath not paid or in any sort Contented Altho' so to do the said Joseph was on the Second day of
March in the year of our Lord one Thousand Seven Hundred and forty Six and often
before and since at Charles County afs.d by the said James & Company Requested but the s.d
Joseph the said sum of fifteen Hundred and Two pounds of Tobacco or any part thereof to
them the said James & Company pay or in any sort to Content hath hither to altogether Refused
and still doth Refuse to the Damage of them the sid James & Com Three Thousand one
Hundred pounds of Tobacco and therefore suit is brought & so forth               John Doe
