Domini 1747 By his Certain Writing obligatory with the Seal of him the said Charles Craycroft Sealed and here in Court Produced whose date is the day and year afs.d acknowledged himself to be held and firmly Bound unto the said Joseph Adams in the afs.d sum of Fifty five Pounds sterling money of Great Britain as afs.d to be Paid to the said Joseph Adams when there unto afterwards he should be requested Nevertheless the s.d Charles Craycroft altho often Requested the said sum of Fifty five Pounds sterling as afs.d or any Part thereof to the said Joseph Adams hath not Paid or any sort Contented but the same to him the said Joseph Adams to Pay or in any sort to Content hath hitherto altogether Refused and still doth Refuse to the Damages of the said Joseph Adams One Hundred Pounds sterling as afs.d and therefore suit is brought & so forth John Doe Pled.s &C.a & Rich.d Roe And the afs.d Charles Craycroft by Thomas Clark his attorney Comes & Defends the force and Injury when &Ca and Prays a hearing of the Writing Obligatory and it is Read unto him and he also Prays a hearing of the Condition of the said Writing Obligatory and it is Read unto him in these Words following to wit The Condition of the above obligation is Such that if the above bound Charles Craycroft do and shall well and truly Pay or Cause to be Paid unto the said Joseph Adams his Certain Attorney Executors Adm.rs or Assigns the just sum of Twenty Nine Pounds Three Shillings Sterling at or upon the first day of June Next Ensuing the date hereof with Legal Interest for the same then the above obligation to be Void Else to Remain in full force and Virtue in Law but If default be made in the Payment of the said sum of Twenty Nine Pounds Three shillings sterling Then I Impower any attorney in any Court of Record in the Realms of Great Britain france or Ireland or within the Province of Maryland on this his Majesties Dominions to appear for me at the suit of the above mentioned Joseph Adams and to Receive a Declaration on the above obligation and thereupon to Confess Judgment by Nildicit Cognovit Actionem Nonsum Informatus or otherwise hereby Releasing all the errors that may happen upon the said Judgment suing out Execution thereupon or in any other Proceedings thereunto Relating Sealed & Delivered In the Presence of Charles Craycroft (ss) Thomas Harwood Jun Sam.ll Galloway Which being Read and heard the said Charles Craycroft by his attorney afs.d Comes and Defends the force and Injury when &c.a and say Nothing in barr or Preclusion of the Action ^of the^ afs.d Joseph Adams whereby the same Charles Remains against the said Joseph undefended Therefore it is Considered that the afs.d Joseph Recover against the said Charles Craycroft his Debt afs.d and his Damages by occasion of Detaining that Debt to four Hundred and Seventy Eight Pounds of Tobacco to the same Joseph of his assent by the Court here adjudged and the said Charles in mercy &Ca |
