(111) And how he should Execute that Writt that he should make Known to the Justices afs.d at the Time and Place afs.d and that he should have then and there the Names of those before whom he should make the same Known &Ca And now here at this day to wit the Second Tuesday in June afs.d Comes the said John Moore by Jeremiah Chase his attorney and offers himself against the said Lawrance in the Plea afs.d and the sheriff afs.d Returns to the Court here the Writt afs.d thus Indorsed Vizt Charles County To the Worshipfull the Justices within mentioned I hereby Certifye that on ye 11.th day of May 1747 I attached in the hands of Mary Anne Atchison as the Effects of the within mentioned Lawrance Macnamarra the whole Damages Costs within Mentioned for the use of the within mentioned John Moore and have made known to the above Garnashee that she be and appear at the time and Place within Mentioned to shew Cause if any she hath why the Effects so attached in her hands should not be Condemned for the use of the above mentioned John Moore according to Law attached before William Hanson and John Howard Good and Lawfull men of my Bailywick as I am hereby Directed To Answer S Hanson she Whereupon the said John Moore by his attorney afs.d prays Condemnation of his Damages aforesaid to Two Hundred & forty Pounds of Tobacco and also of his Costs and Charges by him and about the Premises laid out and Expended as afs.d attached in the hands of the said Mary Anne Atchason with Execution thereof to him to be adjudged and the said Mary Anne Atchason altho' Solemnly Called Comes not but makes Default Therefore It is Considered by the Court here that the said John Moore have Condemnation in the hands of the said Mary Anne Atchason for was well the sum of Two Hundred and forty Pounds of Tobacco his Damages afs.d as Two Hundred and sixty Two Pounds of Tobacco for his Costs & Charges by him in and about the Premises laid out and Expended by the Court here adjudged according to the form force and Effect of the act of assembly in those Cases late made and Provided and that the said John have thereof Execution &Ca Mem.o Jeremiah Chase secy on bond
It was Commanded the sheriff that he should take John Mckie late of Charles County Planter if &Ca and him safe Keep so that he should have his body before the Justices of the Lord Propry of his Next County Court to be holden at Charles Town on the Second Tuesday in June Next to answer unto John Hepburn of a plea of Trespass upon the Case and that he should have then and there that Writt &C.a At which day to wit the second Tuesday in June afs.d Comes the afs.d John Hepburn by Thomas Clark his att.y and offers himself against the said John Mckie in the Plea afs.d and the sheriff Namely Samuel Hanson Gent Returns to the Court here that he has taken the body of the s.d John Mckie (Whereupon) |
