at dividing Creek in and for the County aforesaid the third Tuesday of March Ann.o Dom One thousand Seven hundred and Thirty nine to answer unto James Nairn of a plea wherefore with force and Arms the Close of him the said James at Somerset County af.d he did break and Enter and thirty Oak trees and thirty pine trees of the value of three pounds Curr money of Maryland there lately growing did Cut down split into fence Rails and Cary away and other Enormitys to the said James did to the grievous damage of him the same James and against the peace of the Right Honrble the Lord propry that now is &c And the same day is given to the af.d James here &c Att which day here Came the af.d James Nairn by Robert Jenckins Henry his Attorney and the sheriffe to witt John Henry Gent now here returned that he had taken the af.d John Hall whose body here at this day he had ready to answer the af.d James Nairn of the af.d plea as to him it was Commanded Whereupon the af.d John Hall puts in his place William Arbuckle Gent Attorney at Law against the af.d James Nairn of the af.d plea &c And Thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek the third Tuesday of June then next Following in the same state as at present saveing to the parties af.d Att which day here Came again the parties af.d by their Attorney af.d And hereupon the said James Nairn Complained against the af.d John Hall in the plea af.d in form Following Somerset ss.t John Hall late of Somerset County planter was Attached to Answer unto James Nairn of a plea wherefore with force and Arms the Close of him the said James at Somerset County af.d he did break and Enter and thirty Oak trees and thirty pine trees of the value of three pounds Current money of Maryland there lately growing did Cut down split into fence rails and Cary away and other Enormitys to the said James did to the grievous damage of him the same James against the peace of the right Honrble the Lord propry that now is &c And Whereupon the same James by Robert Jenckins Henry his Attorney Complains that the af.d John the first day of March in the year of our Lord one thousand seven hundred thirty and nine with force and Arms the Close of him the said James Called tearsoe at Somerset County af.d he did break and Enter and thirty Oak trees and thirty pine trees of the value of three pounds Curr.t money of Maryland there lately growing did Cut down and Carry away and other Enormitys to him did to the Grievous damage of him the same James and against the peace &c Whereupon he says that he is worse & hath damage to the value of fifty pounds Curr.t money of Maryland and thereupon he brings suit &c Pledgs &c J Doe R: Roe And whereupon the said John Hall by William Arbuckle his Attorney Command defends the force and Injury when &c And prays leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third tuesday of August then next Following and he hath it and the same day is given to the af.d James here also Att which day here Came againe as well the af.d James Nairn as the af.d John Hall by their Attorneys af.d and hereupon the said John pray further leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third Tuesday of November then next Following and he hath it and the same day is given to the af.d James here also Att |
