81 seven hundred and thirty nine to answer unto Moses Challie of a plea of trespass upon the Case &c and the same day is given to the af.d Moses here &c Att which day here Came the af.d Moses Chaille by Francis Allen his Attorney af.d and the sheriffe to witt John Henry Gent now here returned that he had taken the af.d Nathaniel Horsey whose body here at this day he had ready to answer the af.d Moses Challie of the af.d plea as to him it was Commanded Whereupon the af.d Nathaniel Horsey puts in his place George Douglas Gent attorney at Law against the af.d Moses Challie of the af.d plea &c And Thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek the third Tuesday of June then next following in the same state as at present saveing to the parties af.d Att which day here Came againe the parties af.d by their Attorneys af.d and hereupon the said Moses Challie Complained against the af.d Nathaniel Horsey in the plea af.d in form Following Somerset County ss.t Nathaniel Horsey late of Somerset County mariner was Attached to answer unto Moses Challie Jr of a plea of trespass upon the Case &c And whereupon the said Moses by Francis Allen his Attorney Complains that whereas the said Nathaniel the nineteenth day of September Anno Dom Seventeen hundred and thirty at Somerset County af.d within the Jur of this Court was Indebted unto the said Moses in Five pounds Seven shillings and tenn pence Curr.t money of Maryland for Sundrys properly Chargeable in Acc.t to be paid in Corn at twenty pence p bushell as by Account hereunto Court annexed may appear and being so thereof indebted the said Nathaniel in Consideration thereof the day and year af.d at the place af.d upon himself did assume and to the said Moses then and there did faithfully promise that he the said Nathaniel the said Five pounds seven shillings and tenn pence to the said Moses when he should be thereunto request^ed^ well and faithfully he would pay and Content and altho' the said Nathaniel two pounds ten shillings pcell of the af.d Five pounds seven shillings and ten pence to the said Moses he hath Since paid and Satisfied yett as to two pounds seventeen shillings and tenn pence residue thereof the said Nathaniel his promise and Assumption af.d in forme af.d made nothing regarding but plotting and fraudulently Intending the said Moses in that pte Craftilly and Subtilly to deceive and defraud the said two pounds seventeen shillings and ten pence to the said Moses altho' the same to do the said Nathaniel by the said Moses on the twenty Fifth day of March Anno Dom Seventeen hundred and thirty nine and often afterwards at Somerset County af.d he was thereunto requested hath not paid or Contented but the same to him hitherto to pay or Content hath refused and still doth refuse and deny to the damage of the said Moses of Five pounds Fifteen shillings money af.d and thereupon he brings Suit &c Pledg.s &.c J: Doe R: Roe
And the aforesaid Nathaniel Horsey by George Douglas his attorney Cometh and defendeth the force and Injury when &.a and prayeth Leave thereof to Imparle here untill next Court to be held at dividing Creek |
