70 on the holy Evangelist of almighty God saith that being at a Resurvey made by Coll William Whittington On a parcell of Land then belonging to George Betts Lying on Manokin River on the westermost side of a Creek now Called Jeangacokin Creek They then Begun at an Old Stump standing by the af.d Creek side by an Oyster shall Bank about Twenty Yards above a small Cove near about where a Ceader post now stands and this deponant saith George Betts said that Old Stump was the first bounder of his Land and further saith not his George V Phebus mark
thousand seven hundred and forty before John Scott Esq.r and his Associates the said Lord proprietary his Justices of the same County Court and for the same Lord proprietary doth give the same Justices to understand and be Informed that John Scarbrough late of All hallows parish in the said County of Somerset Gent the fifth day of November in the year of our Lord God seventeen hundred and forty with force and arms &c at the parish af.d in the County af.d within the Jurisdiction of this ^Court^ in and upon a Certain John Dreadon in the peace of God and the said Lord proprietary that now is then and there being an assault did make and him the said John then and there did beat wound and evilly treat so that of his life it was greatly dispaired and other harms to the same John Breaden then and there did to the grievous damage of him the said John Dreaden and Contrary to the peace of the right Honourable the Lord proprietary that now is his good rule and Government &c Whereupon the said Attorney of the said Lord proprietary for the same Lord proprietary prays the Advice of the Court here in the premisses an d that due process of Law in this part may be made against the said John Scarbrough to answer unto the said Lord proprietary of and upon the premissis &c Thereupon Command was given to the sheriffe of Somerset County that he should take ^the said^ John Scarbrough if he should be found in his bailywick and him should safe keep so that he might have his body here Immediately before the Justices of his Lordships County Court of Somerset now sitting at dividing Creek to answer unto his said Lordship of the Information af.d &c And afterwards to witt the same day and Year abovementioned Came here before his ^said^ Lordships Justices the aforesaid John Scarbrough in his proper person and had a hearing of the Information aforesaid and saith that he will not plead with his said Lordship but submits with a protestation of his Innocency and puts himselfe upon the favour of the Court Whereupon all and singular the premisses being seen and by the Court here fully understood It is Considered by the Court here that the aforesaid John Scarbrough pay unto his said Lordship the Lord Proprietary for his fine by the Court here upon him Imposed for and by Occasion of the Trespass and Assault aforesaid whereof in form afd he is Convict One Shilling Curr.t money of maryland and that the said John Scarbrough be taken to satisfie his said Lordship of the fine afd &c |
