                        August Court                    1740                26

Sheriffe aforesaid and saith that he Cannot deny the action aforesaid ^of the afd John^ nor Can he say but that he did assume upon himself
in manner and form as the af.d John Henry above against him hath Complained and as to the damage of the same John
by him by Occasion of the premisses in that part sustained the Same Benjamin Townsend saith and Acknowledgeth the
the af.d John hath Sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his Suit in
that part apposed to Nine pounds nineteen shillings and Six pence Current money of Maryland and not more and ^because^ the af.d
John denyes not this but the same allegation Grants to be true prays Judgment for those damages above Acknowledged
together with his Costs and Charges af.d to him to be Adjudged &c

       Whereupon the af.d Benjamin Townsend by the Assent of the af.d John Henry is discharged from the Committment af.d

        Therefore by Consent of the parties af.d it is Considered that the af.d John Henry recover against the af.d Benjamin
Townsend his damages af.d to the af.d Nine pounds nineteen shillings and Six pence Curr.t money of Maryland by the same
241   Benjamin in form af.d Acknowledged as also                                                                          pounds of tobacco for
his Costs and Charges af.d to the same John at his request by the Court now here of the Assent of the parties af.d adjudged
which Certain damages in the whole amounts to Nine pounds nineteen shillings and six pence Current money of Maryland &
                                                                                  pounds of tobacco and the af.d Benjamin in Mercey &c

Nathaniel Whittaker
 Whereas a Certain Nathaniel Whittaker being Committed by One of his Lordships Justices the peace
within the County of Somerset to keep assigned for his the said Nathaniel's want of Security for his good behaviour
and appearance at this Court to answer &a
                                                                         And now to witt the third Tuesday of August Anno Dom One thousand Seven hundred
and forty before his Lordships Justices at a Court then held at dividing Creek in and for the County afd Came the said Nathaniel
Whittaker in his proper person in Custody of the Sheriffe of the County afd in whose Custody before that time for the Cause afd was
Committed and being by the said Sheriffe Ledd to the barr   and for as much as noe person appeared here in Court to pray
that the said Nathaniel might give Security for his good behaviour &a

                Whereupon the said Nathaniel is by the Court here discharged from the Commitmt afd and Ordered to
give Security for the payment of the Severall Officers Fees due by means of the premisses aforesaid  Thereupon a Certain John
Bell of Somerset County Barbour present herein Court in his proper person undertook for the said Nathaniel Whittaker for
to pay the Severall Officers Fees due by means of the premisses and Commitmt afd &c

the body of Somerset County af.d upon their Oath do present that Fraby Dies late of Coventry parish
in the County af.d Spinster the first day of August Anno Dom one thousand seven hundred and thirty
Eight at the parish af.d in the County af.d and within the Jur.d of this Court did Committ fornication with a
Certain person to the Jurors af.d unknown and did permitt the Same unknown person then and there to begett a bastard
