261 of her assent of Increase adjudged which Certain damages in the whole amounts to Twenty five pounds Sterling money and One thousand and Seventy and three pounds of tobacco and the aforesaid Wheatly in Mercy &c
August Anno Dom one thousand seven hundred and forty one to answer unto Edmund Hough of a plea of that he render him twenty one pounds Curr.t money of Maryland which to him he owes and unjustly detains &c and the same day is given to the af.d Edmund here &c And the af.d Edmund Hough declared against the af.d Thomas Pingally in the plea af.d in form Following Somerset ss.t Thomas Pingelly late of Somerset County Bricklayer otherwise Called Thomas Pingally of the af.d County and province of Bricklayer was Summoned to answer unto Edmund Hough of a plea that he render him twenty one pounds Curr.t money of Maryland which to him he owes and unjustly detains &c And Whereupon the said Edmund by Geo Douglas his Attorney says that whereas the said Thomas on the xxi day of June Anno Dom MDCCXXXVj at the County af.d by his Certain writing obligatory which the said Edmund sealed with the seal of the said Thomas herein Court brings whose date is the day and year af.d did Acknowledge himself to be held and firmly bound unto the said Edmund in the sum of twenty one pounds Curr.t money af.d to be paid to the said Edmund when he the said Thomas should thereto be required Nevertheless the said Thomas the said twenty one pounds to the said Edmund hath not hitherto rendered but that to doe altogether hath denyed and still doth deny and unjustly detain altho' thereto afterwards to wit on the first day of November in the year af.d at the County af.d and often since that time by the said Edmund required whereupon the said Edmund says he is damnified forty pounds Curr.t money of Maryland and thereof he brings Suit &c Pledg.s &c J Doe & R Roe A Copy of the foregoing declaration was made and sent to be served on the defendant in order for a speedy tryall Att which day here Came the af.d Edmund Hough by George Douglas his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Thomas Pingally whose body hereat this day he had ready to answer the af.d Edmund Hough of the af.d plea as to him it was Commanded and further the said sheriffe returned that he had served the af.d Thomas Pingally with a Copy of the foregoing declaration according to act of Assembly in such Case made and provided &c Whereupon the af.d Thomas Pingally |
