252 above against him hath declared &a Therefore it is Considered that the aforesaid John Henry Recover against the aforesaid John Nicholson his debt aforesaid and his damages by occasion of the detention of the same debt to 265 Two hundred and Eighty Eight pounds of tobacco to the same John Henry of his assent by the Court here adjudged and the aforesaid John Nicholson in Mercy &c
dividing Creek the third Tuesday of march Anno Dom one thousand seven hundred and forty one to answer unto John Woolford of a plea of trespass upon the Case &c and the same day is given to the af.d John here &c Att which day here Came the af.d John Woolford by his Attorney af.d and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Sarah Staples whose body here at this day he had ready to answer the af.d John Woolford of the af.d plea as to him it was Commanded And hereupon the said John Woolford Complained against the af.d Sarah Staples in the plea af.d in form Following Somerset ss/ Sarah Staples late of Somerset County spinster administratrix of all and singular the goods Chattles and Credits which were of James Staples late of Somerset County dec.d who dyed intestate as his said ^was attached^ to answer unto John Woolford of a plea of trespass upon the Case &c And Whereupon the same John by Robert Jenckins Henry his Attorney Complains that whereas the af.d James in his lifetime the tenth day of may in the year of our Lord one thousand seven hundred and thirty & Eight was Indebted unto the same John in the sum of Seven pounds six shillings and three pence Curr.t money of the province of Maryland for divers good wares and merchandizes to the af.d James in his life time by the same John sold and delivered and so thereof Indebted being the af.d James then and there faithfully promise to pay to the same John the af.d seven pounds ^six^ shillings and three pence when thereof afterwards he should be required Nevertheless the af.d James in his life time his promise and assumption af.d little regarding but minding and fraudulently intending the same John in that part Craftily and Suttlely to deceive and defraud the af.d seven pounds six shillings and three pence in his lifetime according to his promise and assumption af.d hath not paid but the af.d James in his life time and the said Sarah after the death of the same James to whom administration of all and singular the goods Chattles rights and Credits which were of the af.d James at the time of his death at Somerset County by Nehemiah King Gent Deputy Comissary of the said County in due form of Law was Committed |
