251 Harrick and valued as aforesaid to thirty three pounds Twelve Shillings and three pence Curr.t money of Maryland may be Condemned as the goods and Chattles Rights and Credits of the aforesaid Daniel Harrick towards Satisfying unto him the Said Samuel Hopkins his debt aforesaid as all Costs and Charges accrewing by means of the attachmt afd &c Thereupon a Certain Robert Jenckins Henry of Sommerset County Gentleman present herein Court in his proper person undertook for the said Samuel Hopkins According to Act of Assembly in such Case made and provided that in Case Daniel Harrick do at any time within a year and a day appear and make all or any part of the said Samuell Hopkins Claim against him to appear to be satisfied or otherwise to have been undue before the Laying of this Attachment that then the said Samuel Hopkins shall make restitution unto the said Daniel Harrick of all or such part as shall be so made appear to be undue as af.d or that he the said Robert Jenckins Henry will do the same for him &c Therefore it is Considered by the Court here that the aforesaid Sum of Sixteen pounds Six Shillings and Eleven pence Curr.t so as aforesaid Acknowledged (as part of the Sum so as aforesaid Attached) by the aforesaid John Records be Condemned in his hands as of the Rights and Credits of the aforesaid Daniel Harrick towards Satisfying unto the said Samuel Hopkins his debt aforesaid and all Costs and Charges accrewing by means of the attachm.t afd and that the aforesaid Samuel Hopkins have thereof Execution against the said John Records according to act of assembly in such Case provided &a Also it is Considered by the Court here that the Severall goods and Chattles so as afd attached of the value of Thirty three pounds Twelve Shillings and three pence Curr.t money of Maryland be Condemned as the goods and Chattles of the aforesaid Daniel Harrick towards Satisfying unto the Said Samuel Hokins his debt aforesaid and all Costs and Charges accrewing by means of the attachmt afd and that the said Samuel Hopkins have thereof Execution &c Memorand.m the aforesaid John Records Garnishe as afd from the residue of the afd attachmt is discharged by the afd Samuel Hopkins &c
Sommerset to be held at dividing Creek the third Tuesday of March Ann Dom One thousand Seven hundred and forty One to answer unto John Henry of a plea that he Render unto him Ten pounds Two Shillings Currant money of Maryland which to him he Owes and Unjustly detains &.c and the Same day is given to the afd Jno Henry here &c Att which day here Came the aforesaid John Henry by Robert Jenckins Henry his attorney and the Sheriffe to witt John Handy Gentleman now here returned that he had Taken the aforesaid John Nicholson whose body here at this day he had ready to [illegible] to the aforesaid John Henry of the afd plea as to him it was Commanded |
