that whereas the said Whittington the Eighth day of August Anno Dom Seventeen hundred and forty one at
the County of Somerset af.d within the Jurisdiction of this Court was Indebted unto the said Moses in twenty one
pounds two shillings and two pence half penny Curr.t money of Maryland for Sundrys properly Chargeable
in Account as by Account thereof here^un^to annexed may in Court appear and being so thereof Indebted the said
Whittington in Consideration thereof the day and year af.d at the County af.d upon himself did Assume and to
the said Moses then and there did faithfully promise that he the said Whittington the said twenty one pounds
two shillings and two pence half penny to the said Moses when he should be there^un^to requested he would well
and faithfully pay and Content and altho' the said Whittington fourteen pounds fifteen shillings pcel of the
af.d twenty one pounds two shillings and two pence half penny to the said Moses he hath paid and satisfied yett as to
six pounds seven shillings and two pence half penny residue of the af.d twenty one pounds two shillings and two
pence half penny the said Whittington his promise and assumption af.d in form af.d made nothing regarding but
plotting and fraudulently Intending the said Moses in that part Craftily and Subtilly to deceive and defraud the said
Six pounds Seven shillings and two pence half penny to the said Moses hath not paid or Contented altho' the same
to do the said Whittington by the said Moses on the af.d Eighth day of August in the year af.d and often afterwards
at the County of Somerset af.d he was there^un^to requested but the same to him to pay or Content hath refused and still
doth refused and deny to the damage of the said Moses of twelve pounds Curr.t money of Maryland aforesaid and
thereupon he brings Suit &c                                                                              Pledg.s &.c  J Doe & R Roe
