243 of Our Lord One thousand Seven hundred and forty One at Sommerset County did make his Certain note in writing Called a promisary note with his proper hand thereto Subscribed bearing date the day and Year last above mentioned and the same note unto the said William did deliver by which said note the said Benjamin did promise to pay unto the same William by the name of William Lockwood or order the sum of Eight pounds Currant bills of Credit at three payments (to witt) Forty Shillings on or before the Eighth day of the month ^of^ may last above mentioned and forty shillings on or before June Court next ensueing the date of the same note and the four pounds residue thereof to be paid the twenty ninth day of September then next ensuing and by reason thereof and by virtue of the statute in that Case lately made and provided the said Benjamin became Chargeable to pay to the said William the said sum of Eight pounds according to the tenor and Effect of the same Note and being so Chargeable the af.d Benjamin in Consideration thereof afterwards to witt the same first day of may in the year of our Lord one thousand seven hundred forty and one at the County af.d upon himself did Assume and to the said William then and there faithfully promise that he the said Benj.a would pay unto the same William the said sum of Eight pounds According to the tenor and Effect of the said note when he thereto afterwards by the same William should be requested Nevertheless the af.d Benjamin as as to ^the^ four pounds in the af.d note mentioned residue of the said sum of Eight pounds) his promise and Assumption af.d in form af.d made little regarding but minding and fraudulently intending the same William in that part Craftily and Subtilly to deceive and defraud the said sum of four pounds on the twenty ninth day od September above mentioned or any penny thereof at any time since to the same William) altho' the same to do the said Benjamin afterwards to witt the thirtieth day of September in the year last above mentioned and often times since at the said County of Somerset by the same William was requested hath not paid or him for the same in any sort Contented but the same four pounds to him to pay or Content hetherto hath refused and still doth refuse to the damage of the said William ten pounds Curr.t money of the province of Maryland and thereof he brings Suit &c Pledg.s &c J Doe & R Roe A Copy of the foregoing declaration was made and sent to be Served on the defendant in order for a speedy tryall Att which day here Came the af.d William Lockwood by his Attorney af.d and the sheriffe (to witt) John Handy Gent now here returned that he had taken the af.d Benjamin Warrington whose body here at this day he had ready to answer the af.d William Lockwood of the af.d plea as to him it was Commanded and further the said sheriffe returned that he had served the af.d Benjamin Warrington with a Copy of the foregoing declaration According to Act of Assembly in such Case made and provided &c And the af.d Benjamin Warrington at the prayer of the af.d William Lockwood is adjudged to give speciall |
