221 against the af.d Samuel ought to recover but because it is not known unto his Lordships Justices here what damages the af.d Duncan hath Sustained by Occasion of the non performance of the promise and Assumption af.d in this part Sustained Therefore Command is to the sheriffe of the County af.d that by the Oath of Honest and Lawfull men of his bailywick he deligently Enquire what Damages the af.d Duncan Murray hath Sustained as well by Occasion of the none performance of the promise and Assumption af.d as for his Costs and Charges by him about his suit in that part expended and the Inquisition which thereupon he takes to his Lordships Justices at the next Court to be held at Dividing Creek the third Tuesday of March then next Following under his Seals and the Seals of them by whose Oath he takes that same Inquisition he send together with the writt thereof to him directed and the same day is given to the af.d Duncan there &c
of the testament and Last will of Thomas Blair deceased if they should be found in his bailywick and them should safe keep so that he might have their bodys before the Justices of his Lordships County Court of Somerset to be held at deviding Creek the third tuesday of June Anno Dom one thousand seven hundred and forty one to answer unto Edmund Hough of a plea of trespass upon the Case &.a and the same day is given to the af.d Edmund here &.a Att which day here Came the af.d Edmund Hough by George Douglas his attorney and the Sherriffe to witt John Handy Gent now here Returned that he had taken the af.d Alexander Buncle Robert King and Ann his wife whose bodys hereat this day he had Ready to answer the af.d Edmund Hough of the af.d plea as to him it was Commanded Whereupon the af.d Alexander Buncle and Robert King and Ann his wife puts in their place William Arbuckle Gent attorney at Law against the af.d Edmund Hough of the af.d plea &.a And hereupon then at the Request of the parties aforesaid day is to them now here given untill next Court to be held at dividing Creek in and for the County af.d the third tuesday of August then next Following in the same state as at present saveing to the parties af.d &.a Att which day here Came againe as well the af.d Edmund Hough as the af.d Alexander Buncle and Robert King and Ann his wife by their attorneys af.d and hereupon the said Edmund Hough Complained of the af.d Alexander Buncle and Robert King and Ann his wife in the plea af.d in form Following Somerset ss Alexander Buncle late of Somerset County Merchant and Robert King late of Somerset County Esq.r and Ann his wife lately Called Ann Blair Executors of the testament and Last will of Thomas Blair dec.d were attached to answer unto Edmund Hough of a plea of |
