205 Sheriffe of the County af.d in satisfaction thereof or that he the said Christopher Dowdle will doe the same for him &c And the af.d Absolum Hobbs by William Arbuckle his Attorney Comes and defends the force and Injury when &c and prayeth leave thereof to Imparle hereuntill next Court to be held at dividing Creek the third Tuesday of August then next Following and he hath it and the same day is given to the af.d William here also &c Att which day here Came again as well the af.d William Brereton as the af.d Absolum Hobbs by their Attorneys af.d and whereupon the said Absolum Hobbs prays further leave thereof to Imparle hereuntill next Court to be held at dividing Creek the third Tuesday of November then next Following and he hath it and the same day is given to the af.d William here also &c Att which day here Came again as well the af.d William Brereton as the af.d Absolum Hobbs by their Attorneys af.d and whereupon the af.d Absolum Hobbs as before defends the force and Injury when &c and says he did not Assume in manner and form as the plantiff above against him hath Complained and of this he puts himself upon the Country And the af.d William Brereton in like manner Therefore it is Commanded the sheriffe that Immediately he should Cause to Come here before his Lordships Justices twelve &c by whom &c and who nither &c to recognize &c because as well &c and the Jurors of that Jury being Called some of them to witt John Dennis J.r John Woolf Woolford George Tull Ephraim Waggaman William Nelson James Polk Moses Mills ^and^ William Gray Come and were Sworn upon that Jury and because the residue of the Jurors of that same Jury did not appear therefore others of those standing by hereunto allected by the sheriffe of the County af.d and at the request of the af.d William Brereton and by the Command of the af.d Justices are newly put on whose names to the pannell within written are affiled According to the form of the statute in such Case made and provided which said Jurors so newly put on to witt David Polk Samuel Powell Samuel Handy & Benjamin Langford being Called Likewise Came who to say the truth of the premisses af.d together with the other Jurors af.d first Impannelled and sworn being Ellected tryed and Sworn upon their Oath say that the af.d Absolum Hobbs did assume upon himself in manner and form as the af.d William Brereton above against him hath Complained and assessed the damages of the same William by Occasion of the non performance of the promise and Assumption af.d beyond his Costs and Charges by him about his Suit in that part apposed to one pound Seventeen Shillings Curr.t money of Maryland and for those Costs and Charges to one pound of tobacco Therefore it is Considered that the af.d William Brereton recover against the af.d Absolum Hobbs his 739 damages af.d by the Jurors af.d in form af.d Assessed as also Seven hundred and Sixty One pounds of tobacco for his Costs and Charges af.d to the same William by the Court now here of his Assent of Increas adjudged which Certain damages in the whole amounts to one pound Seventeen Shillings Cur.t money of Maryland and Seven hundred and 740 Sixty Two pounds of tobacco and the af.d Absolum in mercy &c 740 |
