204 Claywell by their Attorneys af.d and whereupon the af.d Peter and Shadrach Claywells as before defends the force and Injury when &c And say that they are not nor either of them is Guilty of the premisses above upon them Imposed as the af.d Ambross Willet and Ruth his wife above against them have Complained and of this they put themselves upon the Country and the af.d Ambross and Ruth in like manner Therefore it is Commanded the sheriffe of Somerset County that he should Cause to Come ^here^ before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of November then next Following twelve &c by whom &c and who nither &c to recognize &c because as well &c And the same day is given to the af.d parties here &c Att which day here Came again the af.d Peter and Shadrach Claywells by their Attorneys af.d but the same Ambrose and Ruth his wife altho' Solemnly Called Cometh not nor is their writt af.d against the af.d Peter and Shadrach further prosecuted Therefore it is Considered by the Court here that the af.d Ambrose Willett and Ruth his wife take nothing by their writt af.d but that they and their pledges of prosecuting to witt John Doe and Richard Roe are in mercy and that the af.d Peter and Shadrach Claywell goe thereof without day and also it is Considered that the af.d Peter and Shadrach Claywells 200 recover against the af.d Ambrose Willett and Ruth his wife pounds of tobacco for their Costs and Charges by them about their defence in that part Sustained by the Court now here adjudged according to the form of the statute in such Case thereof lately made and provided and the same Peter and Shadrach have thereof Execution &c
Anno Dom one thousand seven hundred and forty to answer unto William Brereton of a plea of trespass upon the Case &c And the same day is given to the af.d William here &c Att which day here Came the af.d William Brereton by George Douglas his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Absolum Hobbs whose body here at this day he had ready to Answer the af.d William Brereton of the af.d plea as to him it was Commanded And hereupon the said William Brereton Complained of the af.d Absolum Hobbs in the plea af.d in form Following Sommerset ss Absolum Hobbs late of Somerset County planter was attached to Answer unto William Brereton of a plea of trespass upon the Case &c And Whereupon the said William by George Douglas his Attorney Complains that whereas the said Absolum Hobbs on the twentyeth day of March Anno Dom MDCCXXXIX at the County af.d was Indebted to the said William in the Sum of Seven pounds Eighteen Shillings and four pence Currt money of Maryland for Sundry matters |
