             November Court                           1741                    182

Entered and made a rule of this Court on the motion of the parties aforesaid   And afterwards on the same Court
before the Justices thereof Came the aforesaid Arbitrators and made return of their arbitrament in the premisses aforesaid
between the parties aforesaid in manner following      pursuant to the Submission of John Scarbrough Gent plft
and Adam Brafford deft according to the statute to us the subscribers we do award and decree that the said
Brafford is Indebted to the said John Scarbrough the sum of six pounds three shillings and nine pence Currt
money of maryland as the Ballance of all accounts between them proceding the date hereof and do award
the said Brafford to pay the said sum to the said Scarbrough accordingly together with the Cost of
this suit given under our hands this 18.th day of November 1741         Will Arbuckle Francis Allen

                Which being read and heard and by the Court here fully understood  It is Considered by the
Court here that the af.d John Scarbrough Recover against the af.d Adam Brafford his damages
af.d to the af.d Six pounds three shillings and nine pence Currt money of maryland by the arbitration
464   af.d ^in form af.d ^ Assed as also                                             Pounds of tobacco for his Costs
and Charges af.d to the same John by the Court now here of his assent adjudged and the af.d Adam
in Mercy &.a

Command was given to the Sheriffe of Sommerset County that he should Take
William Willoughby James Late of Somerset County planter al.s dicts William Willoughby
James if he should be found in his bailywick and him should safe keep so that he might
have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek
the third Tuesday of November Anno Dom one thousand seven hundred and forty one to answer unto Jacob Hindman and
Thomas Stuart of a plea that he render unto them fifteen hundred and Sixty pounds of tobacco which to them he owes and unjustly
detains &c and the same day is give to the af.d Jacob & Thomas here &c

                And the said Jacob Hindman and Thomas Stuart declared of the af.d William Willoughby James in the plea af.d
in form Following
                                        Somerset County ss/   William Willoughby James late of Somerset County planter al.s dict William Williby
James was Summoned to Answer unto Jacob Hindman and Thomas Stuart of a plea that he render unto them fifteen hundred and
Sixty pounds of tobacco which to them he owes and unjustly detains &c

                         And Whereupon the said Jacob and Thomas by Francis Allen their Attorney says that whereas the said
William Willoughby James the ninth day of April Anno Dom one thousand seven hundred and forty at a Certain place Called
Dorchester County to witt at the County of Somerset af.d within the Jur of this Court by his Certain writing obligatory which the
said Jacob and Thomas with the seal of the said William Willoughby James Signed hereinto Court being the date whereof is the same
day and year did promise to pay to the said Jacob Hindman and Thomas Stuart the af.d Sum of fifteen hundred and Sixty pounds
of tobacco being for Value received when he should be thereunto requested yett the said William Willoughby James tho' often requested
