170 the said James Townsend or that he the same James should be therein Convict that then he the same James should pay and satisfie unto the said Robert Geddes the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the prison of the sheriffe of the County af.d in Satisfaction thereof or that he the same John Townsend will doe the same for him &c And the af.d James Townsend by Robert Jenckins Henry his Attorney Comes and defends the force and Injury when &c And prays Leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third Tuesday of June then next Following and he hath it and the same day is given to the af.d Robert here also &c Att which day here Came again as well the af.d Robert Geddes as the af.d James Townsend by their Attorneys af.d And Whereupon the said James as before defends the force and Injury when &c And says that he is not Indebted to the af.d Robert Gaddess the af.d sum of thirty five pounds Currt money and three hundred thirty Eighty pounds of Merchantable Tobacco or any part of the said money or tobacco in form af.d in which the same Robert Gaddess above against him hath declared And of this he puts himself upon the Country &c And hereupon the said Robert Geddes prays Leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third Tuesday of August then next Following and he hath it and the same day is given to the af.d James here also &c Att which day here Came again as well the af.d Robert Geddes as the af.d James Townsend by their Attorneys af.d And whereupon the said James Relinquisheth his verification af.d by him above alledged sayth that he Cannot ^deny^ the action aforesd of the aforesaid Robert Geddes nor but that he Owes the Same Robert the aforesaid thirty five pounds Currant money of Maryland and three hundred and thirty Eight pounds of Merchantable tobacco in manner and form as as the aforesaid Robert above against him hath declared Therefore it is Considered that the aforesaid Robert Geddes Recover against the aforesaid James Townsend his debt aforesaid and his damages by Occasion of the detention of the Same debt to 490 pounds of tobacco to the same Robert of his assent by the Court here Adjudged and the aforesaid James in mercy &c Memorand.m the plantife releaseth out of the above debt
Francis Lee of a plea of trespass upon the Case &c And the same day is given to the af.d Francis here &c Att which day here Came the af.d Francis Lee by Robert Jenckins Henry his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d John Waller whose body here at this day he had ready to answer the af.d Francis Lee of the af.d plea as to him it was Commanded Whereupon the af.d John Waller puts in his place Francis Allen Gent Attorney at Law against the af.d Francis Lee of the af.d plea |
