was attached to answer unto unto David Wilson of a plea of trespass upon the Case &a

       And Whereupon the same David by Robert Jenckins Henry his attorny Complains
that whereas the af.d Heber the thirtyeth day of January in the year of our Lord one thousand seven
hundred and forty at Somerset County af.d was Indebted unto the same David in the sum of thirty
and six pounds five shillings and nine pence Currt money of the province of maryland for sundry
Articles properly Chargeable in an account as by an account thereof hereinto Court brought and ready
to be produced may appear and so thereof Indebted being the af.d Heber afterwards to witt the same
day and year above mentioned at the County af.d in Consideration thereof upon himself did assume
and to the same David then and there faithfully promise that he the af.d Heber the af.d thirty and six
Pounds five Shillings and nine pence when thereof afterwards he should be requested would well and
faithfull pay and Content and Altho' the af.d Heber Fifteen pounds twelve shillings and eight pence
part of the af.d sum of thirty and six pounds five shillings and nine pence unto the same David he
hath since paid and satisfied   Nevertheless the af.d Heber as to Twenty pounds thirteen shillings
and one penny of the said sum of thirty six pounds five shillings and nine pence residue his promise
and assumption af.d in form af.d made Little regarding but minding and fraudulently intending
the same David in that part Craftilly and Suttlely to deceive and defraud the af.d sum of thirty twenty
pounds thirteen Shillings and one penny unto the same David (altho' the same to do the said Heber
Afterwards (to witt) the same day and year af.d and often since that time at Somerset County af.d
by the same David Requested he hath not paid or him for the same in any sort Contented
but the same to him hetherto to pay hath ^altogether^ refused and still doth refuse  Whereupon the same
David says he is worse and hath damage to the Value of fifty pounds Currt money of maryland
and thereof he brings suit &.a                                          Pledges &.a J: Doe & R: Roe
