167 Whereupon the af.d John Caldwell puts in his place William Arbuckle Gent attorney at Law against the af.d Robert Givan of the af.d plea And thereupon at the Request of the parties af.d day is to them now here given untill Court to be held at dividing Creek in and for the County af.d the third tuesday of June then next Following in the same state as at present saveing to the parties af.d &.a Att which day here Came againe the parties af.d by their attorneys af.d and hereupon the said parties present herein Court in their proper persons submitted their dispute in this action to the Arbitrament of George Douglas and William Arbuckle of Somerset County Gentlemen and it is agreed by and between the parties af.d that the af.d Arbitrators Return the ^their^ arbitrament in writing under their hands and seals to the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of August then next Following that the same Justices may proceed thereon to Judgment against either of the parties af.d as if the same Cause were determined by the same Court and it is further agreed by and between the parties af.d that that Submission be made a rule of this Court therefore it is ordered that the Submission af.d in manner and form af.d made according to the form and effect of the statute in that Case made lately made and provided be entred and made a Rule of this Court on the motion of the parties af.d &.a Att Which day here Came againe the said John Caldwell by his attorney afd and hereupon the said Robert Givan altho' Solemnly Called Came not nor is his writt afd against the afd John Caldwell farther prosecutes Therefore it is Considered by the Court here that the aforesaid Robert Givans Executor as afd take nothing by his writt aforesaid but that he and his pledges of prosecuting be in mercy and that the Same Robert name pledges and that the said John Caldwell goe thereof without day &a
to Answer unto Mathew Kemp of a plea of trespass upon the Case &c And the same day is given to the af.d Mathew here &c Att which day here Came the af.d Mathew Kemp by George Douglas his Attorney and the sheriffe to witt Handy |
