165 him to render hath denyed and still doth deny and unjustly detain altho' thereto afterwards to wit on the XXI day of November Anno Dom MDCCXL at the County af.d and often since that time by the said Joseph Required Whereupon he says he is damnifyed eighty pounds Currt money of maryland and thereof he brings suit &.a Pledges &.a J Doe and R Roe And the af.d Seward Tomlinson by his attorney af.d Comes and defends the force and Injury when &.a and says that he is not Indebted to the af.d Joseph the af.d Forty pounds Currt money of maryland in Silver or whole Gold or eighty pounds paper money of maryland or any penny thereof in form in which the same Joseph above against him hath declared and of this he puts himself upon the Country And hereupon the said Joseph Houston prays Leave thereof to Imparle hereuntill Next Court to be held at dividing Creek in and for the County af.d the third tuesday of August then next Following and he hath it and the same day is given to the af.d Seward here also &.a Att which day here Came againe as well the af.d Joseph Houston as the af.d Seward Tomlinson by their attorneys af.d And Whereupon the said Seward Relinquisheth his Verification ^afd^ by him above pretended and saith that he Cannot deny the action af.d of the af.d Joseph Houston nor Can he say but that ^the writing obligatory af.d is the deed of the same Seward nor Can he say but that^ he oweth the same Joseph the af.d forty pounds Currt money of maryland in Silver of or whole Gold or eighty pounds paper money of maryland in manner and form as the af.d Joseph above against him hath declared Therefore it is Considered that the af.d Joseph Houston Recover against 41 the af.d Seward Tomlinson his debt af.d and his damages by occasion of the detention of the same debt to 399 fourteen hundred and fifteen Pounds of tobacco to the same Joseph of his assent by the Court here adjudged and the af.d Seward in mercy &.a
hundred and forty to Answer unto Benjamin Warrington of a plea of trespass upon the Case &c and the same day is given to the af.d Benjamin here &a Att which day here Came the af.d Benjamin Warrington by Francis Allen his Attorney and the sheriffe (to witt) John Handy Gent now here returned that he had taken the af.d James Townsend whose body here at this day he had ready to Answer the af.d Benjamin Warrington of the af.d plea as to him it was Commanded Whereupon Came here into Court the af.d James Townsend in his proper person And thereupon the said James Townsend at |
