156 Which Certain damages in the whole ammounts to Fourteen pounds paper money ^Maryland Currency^ or Seven pounds Verginia Currency and Pounds of tobacco with stay of Execution untill the tenth day of November next Following and the af.d Francis in mercy &.a
And whereupon the same Philip by Robert Jenckins Henry his attorney says that whereas the aforesaid Peter on the xxij day of march in the Year of Our Lord One thousand seven hundred and forty at Sommerset County afd by his Certain writing Obligatory did grant himselfe to be held and firmly bound in the same Philip Lee in the aforesaid Ninty five pounds Eight Shillings and Six pence Sterling to be paid to the Same Philip Lee when thereof he should be requested Nevertheless the afd Peter altho' often requested the said ninty five pounds Eighty Shillings and Six pence Sterling to the same Philip hath not as yet Rendered but the same to him hetherto to render hath altogether refused and still doth refuse to the damage of the same Philip Lee One hundred pounds sterling and thereupon he brings suit &.a and brings into Court here the writing afd which the debt afd in form afd doth testifie the date of which is the same day and Year afd Pledges &.a Jn.o Doe & R Roe And the aforesaid Peter Taylor by George Douglas his attorney Cometh and defendeth the force and Injury when &.a and saith that he Cannot deny the action afd of the afd Philip Lee nor Can he say but that the writing Obligatory afd is the deed of the same Peter nor Can he say but that he Owes the same Philip the aforesaid Philip Lee the afd Ninety five pounds Eight Shillings and six pence Sterling in manner and form as the afd Philip above against him hath declared Therefore it is Considered that the afd Philip Lee Recover against the afd Peter Taylor his debt afd and his damages by Occasion of the detention of that Same debt to 275 pounds of tobacco to the same Philip of his assent by the Court here adjudged and the afd Peter in mercy &.a Memorandm the plft Releaseth out of the above debt fourteen pounds ten Shillings and Seven pence Sterling &a
