15 Justices at a Court then held at dividing Creek Twelve &.a by whom &.a and who neither &.a to Recognize &.a because as well &.a and the Jurors of that same Jury thereof Impannelled being Called Came and hereupon the af.d Francis Relinquisheth his verification af.d by him above pretended and saith that he Cannot deny the Action af.d of the af.d William Jones nor Can he say but that he did assume upon himself in manner and form as the af.d William Jones above against him hath Complained and as to the damage of the same William by him by Occasion of the premisses in that part sustained the said Francis saith and acknowledgeth that the af.d William hath sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to two pounds fifteen Shillings and seven pence and one half penny Currt money of maryland and not more and because the af.d William denys not this but the same Allegations grants to be true prays Judgment for those damages above acknowledged together with his Costs and Charges to him to be adjudged &a Therefore by Consent of the parties af.d it is Considered that the af.d William Jones Recover against the af.d Francis Tate his damages af.d to the af.d two pounds fifteen Shillings and seven pence and one half penny Currt money as also three hundred and fifty Nine pounds of tobacco for his Costs and Charges af.d to the same W.m at his request by the Court now here of the assent of the parties af.d Adjudged which Certain damages in the whole amounts to two pounds fifteen Shillings and seven pence and one half penny Currt money and three hundred and fifty Nine pounds of tobacco and the af.d Francis in mercy &.a
have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of March Anno Dom one thousand seven hundred and thirty nine to Answer unto Littleton Townsend Administrator with the will annexed of Job all and Singular the goods Chattles and Creditts which were of Job Shary dec.d at the time of his death of a plea that he render unto him fifteen thousand and fifty six pounds of tobacco which ^from^ to him he unjustly detains &.a and the same day is given to the af.d Littleton here &.a Att which day here Came again the parties af.d by their attorneys af.d And hereupon the said Littleton Townsend declared against the af.d Charles Revill in the plea af.d in form following Somerset |
