141 Court now here of his assent of Increase Adjudged which Certain damages in the whole amount to Twenty One pounds Currant 708 money of Maryland and pounds of tobacco and the aforesaid Joshua in mercy &a Ordered that Elias Glass Recover against Robert Geddes One hundred and Eighty pounds of tobacco being due unto him for his attendance Six days as an Evidence on behalfe of the said Robert Geddes against John Bell he having made Oath to the same &a
of a plea of trespass upon the Case &c and the same day is given to the af.d John here &c Att which day here Came the af.d John Kilbee by ^George Douglas^ his Attorney af.d and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d William King whose body here at this day he had ready to answer the af.d John Kilbee of the af.d plea as to him it was Commanded And hereupon the said John Kilbee Complained against the af.d William King in the plea af.d in form Following Somerset ss William King late of Somerset County Inholder was Attached to answer unto John Kilbee of a plea of trespass upon the Case &c And Whereupon the said John by Geo Douglas his Attny Complains that whereas the said William on the Eleventh day of may Anno Dom MDCCXLi at the County af.d was Indebted to the said John in the sum of Seven pounds nine shillings and Six pence Curr.t money of maryland for Sundry matters and things properly Chargeable in acc.t as by an Account thereof hereto annexed may appear and so be thereof Indebted on Consideration thereof afterwards to wit the day and year last af.d at the County af.d on himself did ^assume^ assue and to the said John then and there faithfully promise that he the said William the said Seven pounds nine shillings and Six pence Curr.t money when he should be afterwards thereto requested he would faithfully pay and Content and altho' the said William hath paid to the said John one pound Eighteen shillings part of the said Seven pounds nine shillings and six pence Nevertheless as to five pounds Eleven shillings and Six pence residue of the said Seven pounds nine shillings and Six pence the said William his promise and Assumption af.d in form af.d made not regarding but minding and fraudulently intending the said John in that part Craftily and Subtilly to deceive and defraud the said five pounds Eleven shillings and Six pence to the said John hath not paid but that to doe altogether hath refused and still doth refuse altho' thereto afterwards to wit on the day and year last af.d at the County af.d and often since that time by the said John required whereupon he says he is the worse twelve pounds Curr money of maryland & thereof he brings Suit &c Pleg &c J Doe R Roe
