GD WA  Francis Tate
 Command was given to the Sheriffe of Somerset County that he should take Francis
Tate late of Somerset County planter if he should be found in his Bailywick and him should
safe keep so that he might have is body before the Justices of his Lordships County Court County
of Somerset to be held at dividing Creek in the same County the third tuesday of June Anno Dom one thousand seven
hundred and forty to answer unto William Jones ^of Nanseongo^ of a plea of trespass upon the Case &.a  And the same day is given to the
af.d William here &.a

                         Att which day here Came againe the parties af.d by their attorney af.d  And hereupon the said William Complained
against the af.d Francis in the plea af.d in form following         Somerset ss.t  Francis Tate late of Somerset County
Planter was Attached to Answer unto William Jones of Neseongo of a plea of trespass upon the Case &c

    And Whereupon the same William by Robert Jenckins Henry his attorney Complains that whereas
the af.d Francis the fifteenth day of February in the year of our Lord one thousand seven hundred and
thirty nine at Somerset County af.d was Indebted unto the same William in the sum of three pounds
Six Shillings one penny and the half of one penny Currt money of maryland for three hundred
eighty and nine pounds of pork by the af.d Francis of the same William before that time bought
had and received as by an account thereof hereinto Court brought may appear and so thereof
Indebted being the af.d Francis afterwards (to witt) the same day and year af.d at the County af.d
in Consideration thereof upon himself did assume and to the same William then and there faithfully
promise that he the af.d Francis the said sum of three pounds six Shillings one penny and one half
penny unto the same William when thereof afterwards requested would well and faithfully pay
and Content and altho the af.d Francis ten Shillings and six pence part of the af.d sum of three
pounds six Shillings one penny and the half of one penny unto the said William hath since
paid and satisfied  Nevertheless the af.d Francis as to two pounds fifteen shillings seven
pence and one half penny of the af.d three pounds six shillings and one penny half penny
residue his promise and assumption af.d in form af.d made not regarding but minding and
fraudulently Intending the same William in this part part Craftilly and Subtilly to deceive and
and defraud the said sum of two pounds fifteen Shillings and seven pence half penny unto the said
William he hath not paid or him for the same in any sort Contented altho the same to do the afd
Francis afterwards to witt the same day and year above mentioned and often since that time at
Somerset County af.d by the same William was requested but the same to him to pay or in any
sort Content the said Francis hath hetherto altogether refused and still doth refuse whereupon
the same William says that he is worse and hath damage to the value of seven pounds Currt money
of maryland and thereof he brings suit &a                                        Pledges &.a J Doe and R Roe
