Lordships County Court of Somerset to be held at dividing Creek the third tuesday of November Anno Dom one thousand seven hundred and forty to answer unto John Wildman of a plea of trespass upon the Case &.a and the same day is given to the af.d John here &.a Att which day here Came the af.d John Wildman by Francis Allen his attorny and the Sheriffe to witt John Handy Gent now here returned that he had taken the af.d Archibald M.ccNeal whose body hereat this day he had Ready to answer the af.d John Wildman of the af.d plea as to him it was Commanded And hereupon the said John Wildman declared against the af.d Archibald M.ccNeal in the plea af.d in form Following Somerset County ss Archibald M.ccNeal late of Somerset County Joyner ws attached to answer unto John Wildman of a plea of trespass upon the Case &.a And Whereupon the said John by Francis Allen his attorny Complains that whereas the said Archibald the thirtieth day of August Anno Dom Seventeen hundred and forty at the County af.d within the Jurisdiction of this Court was Indebted unto the said John in fifty one pounds and eight pence half penny Currt money of maryland for sundrys properly Chargeable in account as by account thereof hereunto annexed may in Court appear and being so thereof Indebted the said Archibald in Consideration thereof the day and year af.d at the County af.d upon himself did assume and to the said John then and there did faithfully promise that he the said Archibald the af.d fifty one pounds and eight pence half penny to the said John when he should be afterwards thereunto Requested he would well and faithfully pay and Content And altho' the said Archibald fourteen pounds Fourteen Shillings and six pence parcell of the af.d Fifty one pounds and eight pence half penny to the said John he hath paid and satisfied Yett as to thirty six pounds six shillings and two pence half penny residue of the af.d fifty one pound and eight pence half Penny the said Archibald his promise and assumption af.d in forme af.d made nothing regarding but plotting and fraudulently Intending the said John in that part Craftilly and Subtilly to deceive and defraud the af.d thirty six pounds six shillings and two pence half penny to the said John hath not paid or Contented altho' the same to do the af.d Archibald by the said John on the af.d thirtieth day of August in the year af.d and often afterwards at the County af.d he was thereunto Requested but the same to him hetherto to pay or Content hath refused and still doth Refuse and Deny Whereupon the said John saith he is worse and hath damage to the value of Seventy pounds Currt money of maryland and thereof he brings suit &.a Pledges &.a J: Doe and R: Roe |
