1741 124 And the af.d Joarib Field by William Arbuckle his Attorney Comes and defends the force and Injury when &.c and prayeth leave thereof to Imparle here untill next Court to be held at dividing Creek the third Tuesday of June then next Following and he hath it and the same day is given to the af.d John here also &c Att which day here Came again as well the af.d John Newbold as the af.d Joarib Field by their Attorneys af.d And thereupon the same attorney of the said Joarib saith that he Cannot deny the action aforesaid of the aforesaid John Newbold nor can he say but that the said Joarib did assume upon himselfe in manner and form as the aforesaid John Newbold above against him hath Complained and as to the damage of the same John Newbold by him by Occasion of the premisses in that part sustained the same Joarib Field saith and acknowledgeth that the af.d John hath sustained damages by occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to ten pounds four shillings and Eleven pence Curr.t paper money of Maryland and not more and because the af.d John denys not this but the same allegation grants to be true prays Judgment for those damages above acknowledged together with his Costs and Charges af.d to him to be adjudged &c Therefore by Consent of the parties af.d it is Considered that the af.d John Newbold recover against the af.d Joarib Field his damages af.d to the af.d ten pounds four shillings and Eleven pence Curr.t paper money of Maryland by 330 the same Joarib in form af.d acknowledged as also pounds of tobacco for his Costs and Charges af.d to the same John at his request by the Court now here of the Assent of the parties af.d Adjudged which Certain damages in the whole amounts to ten pounds four Shillings and Eleven pence Currant paper money of Maryland and pounds of tobacco with stay of Execution untill monday the day before August Term then next following and the aforesaid defend.t in Mercy &c
answer unto Archibald M.cNeal of a plea of trespass upon the Case &c and the same day is given to the af.d Archibald here &c Att which day here Came the af.d Archibald McNeal by George Douglas his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d John Wildman whose body here at this day he ad ready to answer the af.d Archibald McNeal of the af.d plea as to him it was Commanded Att which day here Came again the parties af.d by their attorneys af.d And hereupon the said Archibald McNeal Complained against the af.d John Wildman in the plea af.d in form Following Somerset ss John Wildman late of Somerset County planter was attached to answer unto Archibald McNeal of a plea of trespass upon the Case &c And Whereupon the said Archibald by George Douglas his Attorney Complains that whereas on the Eleventh day |
