121 the County af.d within the Jurisdiction of this Court was Indebted unto the said Joyce whilst she was sole in the sum of five pounds Lawfull money of America for two Cowes two two year old stears two two year old heifers and one Cow yearling by the said Joyce when she was sole to the said John at the special Instance and Request of the said John before that time sold and delivered and being so thereof Indebted the said John the day and year af.d at the County af.d in Consideration thereof upon himself did assume and to the said Joyce whilst she was sole then and there did faithfully promise that he the said John the said Five pounds to the said Joyce whilst she was sole he would well and faithfully pay and Content Nevertheless the said John his promise and assumption af.d in form af.d made nothing ^Regarding^ but plotting and ^fraudulently^ Intending the said Joyce whilst she was sole and the said Leonard and Joyce since the Espousals between them Celebrated in that part Craftilly and Subtilly to deceive and defraud the said Five pounds to the said Joyce whilst she was sole or to the af.d Leonard and Joyce after the Espousals between them Celebrated hath not paid altho' the same to do the said John by the said Joyce whilst she was sole to witt on the af.d first day of May Anno Dom Seventeen hundred and thirty three and often afterwards at Somerset County as afd he was hereunto Requested and by the said Leonard and Joyce since the Espousals between them Celebrated (to witt) on the first day of March Anno Dom Seventeen hundred and thirty Nine and often afterwards at Somerset County af.d he was thereunto requested but the same to the said Joyce whilst she was sole or to the said Leonard and Joyce since the espousals between them Celebrated to pay hath refused and the same of the said Leonard to pay still doth refuse and deny to the damage of the said Leonard and Joyce of twenty pounds Currt money of maryland and thereupon he brings suit &c Pledges &c J: Doe and R: Roe And the af.d John Purnall Jun.r by George Douglas his attorny Comes and defends the force and Injury when &.a and prayeth Leave thereof to Imparle here untill next Court to be held at dividing Creek the third tuesday of November then next Following and he hath it and the same day is given to the af.d Leonard and Joyce here also &.a Att which day here Came againe as well the af.d Leonard Johnson and Joyce his wife as the af.d John Purnall Jun.r by their attornys af.d and Whereupon the said John Purnall Jun.r prays further Leave thereof to Imparle here untill next Court to be held at dividing Creek the third tuesday of March then next Following and he hath it and the same day is given to the af.d Leonard and Joyce here also &c Att which day here Came againe as well the af.d Leonard Johnson and Joyce his wife as the af.d John Purnall Jun.r by their attorneys af.d and Whereupon the said John Purnall Jun.r as before defends the force and Injury when &.a and says that he did not Assumme upon himself in manner and form as the said Leonard and Joyce his wife above against him have Complained and of this he puts himself upon the Country and the af.d Plantiffs in Like manner And the said John by the Leave of the Court here and according to the form of the statute in that Case lately made and provided further says that the said Leonard and Joyce their action af.d against him to have and maintain ought not because he says that he the said John at any time within three years next before the {Impetration |
