by the sheriffe of the County aforesaid and at the Request of the aforesaid William Kitchen and by the Command of
the aforesaid Justices are newly put on whose names to the pannell within written are afiled according to the form of Statute
in such Case made and provided which said Jurors so newly put on to witt William Brown Charles Dashiell and
David Polk being Called Likewise Came who to say the truth of the premisses aforesaid together with the Other Jurors
aforesaid first Impannelled and Sworn being Elected Tryed and Sworn upon their Oath Say that the af George
Bozman in his Life did assume upon himselfe in manner and form as the afd William Kitchen above against
the aforesaid Mary hath Complained and assessed the damages of the Same William by Occasion of the non performance
of the promise and assumption aforesaid beyond his Costs and Charges by him about his Suit in this part
Expended to five pounds Curr.t money of Maryland and for those Costs and Charges to One pound of tobacco

          Therefore it is Considered that the aforesaid William Kitchen Recover against the aforesaid Mary
Bozman his damages aforesaid by the Jurors aforesaid if form aforesaid assessed as also
913                                           pounds of tobacco for his Costs and Charges aforesaid to the same William by
the Court here of his assent adjudged which damages in the whole amount to five pounds Curr.t money of Maryland and
914                                                                      pounds of tobacco of the goods and Chattles which were of the
aforesaid George Bozman at the time of his death in the hands of the aforesaid Mary Remaining to be administred
if so much goods and Chattles in her hands she hath and if so much in her hands she hath not than the Costs afd to
be Levied of the proper goods and Chattles of the aforesaid Mary and the afd Mary in Mercy &c

    Command was given to the sheriffe of Somerset County that he should take George
Russell late of Somerset County Merchant if he should be found in his bailywick and him
should safe keep so that he might have his body before the Justices of his Lordships
County Court of Somerset to be held at dividing Creek third Tuesday of August Anno Dom
one thousand seven hundred and forty to answer unto thomas Nevett of a plea of trespass upon the Case &c and the sam^e^ day
is given to the af.d Thomas here &c

                            Att which day here Came the af.d Thomas Nevett by William Arbuckle his Attorney and the sheriffe to witt
John Henry Gent now here returned that he had taken the af.d George Russell whose body here at this day he had ready to
answer the af.d Thomas Nevett of the af.d plea as to him it was Commanded

          Whereupon the said George Russell being present here in Court in his proper person at the prayer of
the aforesaid Thomas Nevet is adjudged to give Special bail to the action aforesaid but for want thereof the said
George Russell is Committed into the Custody of the Sheriffe of the County of Somerset thereto remaine the said
Sheriffe to witt John Handy Gent present here in Court took Charge of the said George Russell accordingly

                         And thereupon at the Request of the parties aforesaid day is to them now here given untill next
Court to be held at dividing Creek in and for the County aforesaid the third Tuesday of November then next
Following in the same state as at present saving to the parties aforesaid &c
