Therefore it is Considered that the aforesaid Alexander Buncle recover against the aforesaid Hugh Henry
317   his debt aforesaid and his damages by Occasion of the detaining of the same debt to
299                   pounds of tobacco to the same Alexander of his assent by the Court here adjudged with Stay of Execution untill
the first day of October then next following and the afd deft in mercy &a

RH  Heber Whittingham

          Command was given to the sheriffe of Somerset County that he should take
Heber Whittingham Late of Somerset County Inholder if he should be found in his
bailywick and him should safe keep so that he might have his body before the Justices

of his Lordships County Court of Somerset to be held at dividing Creek in the same County the third
tuesday of November Anno Dom one thousand seven hundred and thirty nine to Answer unto
William Ellegood of a plea of trespass  upon the Case &.a and the same day is given to the af.d William
here &.a
                               Att which day here Came the af.d William Ellegood by George Douglas his attorney
and the sheriffe to witt John Henry now here returned that he had taken the af.d Heber Whittingham
whose body here at this day he had ready to Answer the af.d William Ellegood of the af.d plea
as to him it was Commanded         Whereupon the af.d Heber Whittingham at the prayer of the
af.d William Ellegood is adjudged to give Speciall Bail to the Action af.d

          Whereupon Came here into Court a Certain Smith Horsey of Somerset County planter in his
proper persona nd undertook for the said Heber Whittingham (Likewise the said Heber
Whittingham present herein Court in his proper person assumed upon himself) that if it should
happen that Judgment in the plea af.d should be rendred from the same William against the af.d
Heber or that he the said Heber should be therein Convict that then he the said Hugh should pay
and Satisfie unto the said William the Judgment of the Court thereupon or render his body in
Execution of such Judgment to the prison of the Sheriffe of the County af.d in Satisfaction thereof
or that he the same Smith Horsey will do the same for him &.a

    And hereupon the said Heber puts in his place Robert Jenckins Henry Gent Attorney at Law
against the af.d William Ellegood of the af.d plea

          Whereupon at the request of the parties af.d day is to them now here given untill next Court
to be held at dividing Creek the third tuesday of march then next following in the same state as at
present saveing to the parties af.d
                                                             Att which day here Came Again the parties af.d by their
                                                                                                                                        Attorneys
