119 hereupon the said William Kitchen Complained against the af.d Mary Bozman in the plea af.d in form Following Somerset ss Mary Bozman late of Somerset County Widdow Administratrix of all and Singular the Goods Chattles Rights and Credits which were of George Bozman her late husband deceased at the time of his death who died Intestate was attached to answer unto William Kitchen of a plea of trespass upon the Case &.a And Whereupon the same William by Robert Jenckins Henry his attorny Complains that whereas the af.d George Bozman in his life time after the first day of May in the year of our Lord one thousand seven hundred and five (to wit) the fifth day of September in the year of our Lord one thousand seven hundred thirty and three at Somerset County af.d did make his Certain note in writing Called a promissary note with his proper hand thereunto subscribed bearing date the same day and year last above mentioned which said note the af.d George to the same William by the name of William Kitchen or his assigns Eight thousand good merchantable Statute in such Case lately made and provided the same George in his Life time became Chargeable to pay to said William or his order the af.d eight thousand hogshead staves upon demand according to the tenor of the note af.d and so thereof Chargeable to pay being the af.d George in his Life time in Consideration thereof afterwards (to witt) the same day and year last mentioned at Somerset County af.d upon himself did assume and to the same William then and there faithfully promise to pay to him the hogshead Staves af.d Agreeable to the tenor of the same note Nevertheless the af.d George in his Life time and the af.d Mary after the death of him the said George to whom Administration of all and Singular the goods Chattles Rights and Credits which were of the af.d George at the time of his death at Somerset County af.d was Committed) the promise and assumption af.d of him the said George so as af.d made little regarding but minding and fraudulently Intending the same William of the eight thousand Hogshead Staves af.d Craftilly and Subtilly to deceive and defraud the said Staves or any of them unto the said William have not paid or in any sort Contented (altho' the same to do the af.d George in his life time Afterwards (to witt) the same day and year last above mentioned and the af.d Mary after the death of the af.d George (to witt) the Tenth day of August in the year of our Lord one thousand seven hundred thirty nine and often since that time at Somerset County by the same William was Requested) but the same to him to pay or in any sort Content have altogether refused and and the af.d Mary the said Staves to the same William to pay or Content still doth refuse to the damage of him the said William thirty pounds Currt money of the province of maryland and thereof he brings suit &.a Pledges &.a J: Doe and R: Roe: |
