    Archibald MccNeal
    Command was given to the Sheriff of Somerset County
that he should take Archibald Macneal Late of Somerset
County Joyner if he shall be found in his bailywick and
him should safe keep so that he might have his body before the Justices of his Lordships
County Court of Somerset to be held at dividing Creek in the Same County the
third Tuesday of June Ann Dom One thousand seven hundred and thirty
Seven to answer unto Duncan Murray of a plea of trespass upon the Case &.c and
that thereof he Should not fail &c

    And here upon the said Duncan Murray by Geo Duglas his attorney declared
against the said Archibald McNeal in the plea afd in form following
Somerset ss  Archibald McNeal Late of Somerset County Joyner was attached to answer
unto Duncan Murray of a plea of trespass upon the Case &c

    And whereupon the afd Duncan by George Douglas his attorney Complaines
that whereas the said Archibald after the first day of may Ann Dom MDCCV to wit
on the twenty fourth day of february Ann Dom Seventeen hundred & thirty five at Somerset
County afd did make his Certain Note in writing Called a promisary note with his proper
hand Subscrib'd bearing date the day and Year Last mentioned and that note to the said
Duncan then & there did deliver by which note the said Archibald did promise to pay
to the said Duncan ten pounds three Shillings and six pence half penny Currant money
of Maryland for Value received to be paid upon demand by means whereof and by
force of the Statute in that Case Lately made and provided the afd Archibald became Chargable
to pay to the said Duncan the afd Sum of money according to the tenor of that note and
so being thereof Chargable the said Archibald on Consideration thereof afterwards to witt
on the day and Year Last mentioned at the County afd upon himself did assume and to
the said Duncan then & there faithfully did promise to pay the said Sum of money to the
said Duncan according to the tenor of the said note  Nevertheless the said Archibald his
promise and assumption afd in form afd made nothing regarding but minding and
fraudulently Intending the said Duncan in that part Craftilly and Subtilly to deceive and
defraud the afd Duncan of tenn pounds three Shillings and Six pence halfe penny to
the said Duncan hath not paid or him for the same in any Sort Contented but the same
