who to say the truth of the premisses af.d being duely Elected tryed and sworn upon their
Oath do say that the aforesaid Francis Porter did assume upon himselfe in manner and form
as the aforesaid Alexander Buncle above against him hath Complained and assessed the damages
of the Same Alexander by occasion of the non performance of the promise and assumption afd
beyond his Costs and Charges in that part apposed to Twenty Seven pounds and ten pence
Curr.t money of Maryland for those Costs and Charges to One pound of tobacco

          Therefore it is Considered that the afd Alexander Buncle recover against the aforesaid
Francis Porter his damages afd by the Jurors afd in form afd asessed as also Seven hundred & Ninty
772   Four                               pounds of tobacco for his Costs and Charges afd to the Same Alexd
by the Court here of his assent of Increase adjudged which Certain damages in the whole do amount
to Twenty Seven pounds & tenn pence Curr.t money of Maryland and Seven hundred and Ninty five
                                  pounds of tobacco and the afd defend.t in mercy &c

     Command was given to the Sheriff of Somerset County that he Should
take John Asson Late of Somerset County Carpenter if he Should be found
                         in his bailywick and him should safe keep so that he might have his body before the
Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County
the third Tuesday of June Ann Dom One thousand Seven hundred and thirty six to answer unto
Mathis Gale Esq.r of a plea of trespass upon the Case &.c and that thereof he Should not fail &c

       Att which day here before the Justices of his Lordships County Court of Somerset at dividing
Creek Came the afd Mathis Gale by George Douglas his attorney and the Sheriffe of the County afd
to witt Joseph McClester Gent at the Same day here returned that he had taken the afd John Asson
whose body here at this day he had ready to answer the afd afd Mathias Gale of the afd ^plea^ as to him it
was Commanded      Whereupon a Certain Robert Smith Late of Somerset County Gent present here
in Court in his proper person before the Justices afd undertook for the said John Asson and assumed
upon himselfe (Likewise the said John Asson present here in Court in his proper person assumed)
upon himselfe that if it should happen that Judgment in the plea afd in the same Court should
be rendered for the Same Mathias Gale against him the same the same John Asson or that he the same John
